In response to the city review comments, dated August 27, 1998, eight copies of the revised
annexation plat and a revised Annexation Petition are attached. The revisions made are as
follows:
Advance Planning
■ The annexation includes the full existing right-of-way for both County Roads 9 and 36.
City Attorney
a. This statement appears to be contradictory to the City's practice of commonly requiring
serial annexations. A revised, but unsigned, annexation petition is submitted with these
revisions. Signatures will be appropriately affixed to the petition on or after September 251h
and the original will be forwarded to the City at that time.
b. The annexation name has been changed to the Morroni Annexation
Fort Collins —Loveland Water District and South Fort Collins Sanitation District
■ The developer requested to be included in the South Fort Collins Sanitation District but
desires to receive water services from the City of Fort Collins.
Current Planning Department
a. The Annexation Petition and legal description have been revised to indicate annexation of
the full existing right-of-way width for County Roads 9 and 36. The recommendation that the
County be added as a signing owner for the rights -of -way to be annexed is not in
accordance with C.R.S. 31-12-107 (1)(a) and (1)(c)(iii) which state that "landowners of more
than fifty percent of the territory included in the area proposed to be annexed, exclusive of
public street and alleys" must sign the petition. The City Attorney has been consulted on
this issue.
b. The legal description has been appropriately modified.
c. The annexation name has been changed to Morroni Annexation.
