I talked with Kim, and as I expected the little triangle piece of property is located west of Overland Trail
and south of County Road 40E (south, across the road from CSU's Rodeo Stadium).
When the City and County did the Foothills Plan and amended the UGA boundary to bring in the
privately -owned properties west of Overland, this little triangle property was not included in the UGA
because it was owned by CSU. Now, evidently, the property is owned by the City and the Natural
Resources Dept. wants to annex it.
I think I recall the Council's Growth Management Committee provided direction to staff that the City was
not going to annex outside the UGA boundary, even if the purpose of the proposed annexations were to
include natural areas within the city limits. This property is the same situation.
Technically/legally, the UGA Agreement (Section 2.10, D.) still allows the City to annex outside the UGA
boundary after giving a required notice to the County.

Kim alerted me to to this. I asked that she verify with Joe Frank as the keeper of the UGA before we
simply say it was a mapping error and change the maps. If it was indeed a map error and they get
changed, we are prepared to proceed with annexation.

I just bumped into JR and he mentioned the Pineridge 5th (that little triangle). He said that he thought the
problem with annexation was that it was not in the urban growth area but that, actually, the road was
initially drawn in the wrong place, making it look like the triangle was not in the urban growth area. But
that when the road is drawn in the right place, it is in the UGA, and it is his understanding that the intent all
along was that it be in the UGA.
I don't know the status of this annexation, but I just wanted to pass along this conversation.
