All ditch company requirements have been met and matters relating to the ditch and ditch Easement have been agreed to. See copies of our letters of agreement from the pn isident of the ditch company relating to same. Of course, the final document is beir g prepared by Gene Fischer reflecting these agreements must be executed before the ditch company will sign off on the plat and site plan. This fact certainly shoulc not be any cause for delay in proceeding with the Development Agreement. Thank you. 5. Temporary Construction Easement (relating to grading and landscape adjustments on the property immediately to the south in order for the two properties to transition from c ne to the other and integrate properly. Easement has been recorded by title insura ice company. We will provide recording documentation to Mark McCallum in Engin rering as soon as we receive same from the title insurance company. We very much appreciate your assistance with this project and in expediting the Developmen• Agreement so we can get started. Since there are virtually no major public improvements to be constructed, I trust that the Development Agreement will be fairly simple and a mordingly, we can get it completed expeditiously. cc: Mark I AcCallum Enclosures
