However, the Final Development Plan currently is not fully vested because the required engineering
improvements as previous cited have not yet been installed and completed. Therefore, if the required
improvements are not completed by October 5, 2011 then the property owner/developer will have to
submit another request for a 1-year extension, which can be approved only by the Planning & Zoning
Board.
Please let me know if this information is sufficient for you to take to your "Owner" or if more information
would be beneficial.

Happy Friday, Steve, probably wearing the Hawaiian flower shirt today, eh ... ?I was not prepared for the
discussion on the required "... diligen(ce)t in constructing the engineering improvements.." ?! Dave had
not attended the Work Session last Friday, the question didn't really come up.As you stated, a portion of
the PUD has been activated but I think we need clarification on what actually satisfies this portion of the
Boardwalk Crossing project, on-site/private services, utility stubs, public ROW improvements, etc
....?Could you review this further with Steve Dush, Engineering any other Departments and let me know?
I certainly want the Owner to be aware of the specific 'limits' of what Engineering improvements are
required. If by chance, this issue arises again in another 12 months, (given the economy and significant
vacant retail space on the market, it's highly probable), we need some better understanding of the
question and what satisfies that LUC Section?

Steve & Steve,
All the electric facilities (including street lights) are already installed adjacent to this site. All that remains
for Light & Power to install is the electric system to each new transformer when each building develops.
There are no Light & Power issues that would affect the requested extension.

Re: Board Crossing at Mason Street, Final Development Plan
Steve D. and I think that Dave Lingle's question was prompted by the fact that, in today's economic world,
we are beginning to see more extension requests than in the past. Once a developer has received the first
2 administrative extensions that the Director is authorized to grant (as this project has) then any
subsequent extension(s) must go to the Planning & Zoning Board for approval. This is set forth in Section
2.2.11(D)(4) Extensions of the Land Use Code (LUC). The Board is just doing their due diligence to
ensure that the LUC requirements are being addressed and properly applied.
Regarding your question about what actually satisfies this portion of the Boardwalk Crossing project, on-
site/private services, utility stubs, public ROW improvements, etc., and what must be made to fully vest
the project, the following criteria is set forth in Section 2.2.11(D)(3) Term of Vested Right of the LUC:
Within a maximum of three (3) years following the approval of a final plan or other site specific
development plan, the applicant must undertake, install and complete all engineering
improvements (water, sewer, street, curb, gutter, street lights, fire hydrants and storm drainage) in
accordance with City codes, rules and regulations.
Sheri Langenberger and I investigated the status of the Boardwalk Crossing at Mason Street, Final
Development Plan this morning and found that:
` Water and sanitary sewer services have not yet been extended to either of the approved new building
sites on the Boardwalk Crossing at Mason Street development plan.
The public sidewalks along Boardwalk Drive and South Mason Street, adjacent to these proposed
buildings on Lots 1 & 2, have not yet been installed.
There are proposed surface storm drainage improvements on Lots 1 & 2 that will tie into existing
underground storm drains that are not yet constructed.
' We will have to further investigate the status of street lights along Boardwalk Drive and South Mason
Street; and, locations of fire hydrants as they relate to this development plan.
