planning and design that accommodates pedestrians.
This one (1) year extension request, to October 5, 2011, for the Boardwalk Crossing at Mason
Street, Project Development Plan - Final Plan complies with the purpose of the C District as it is
an infill project, as part of a previously approved PDP under the LUC, which will provide
complementary and supporting land uses that serve the community in general. The future
presence of additional offices and retail establishments in this area remains a benefit to the
community. Staff recommends approval of the one (1) year extension request.
6. Findings of Fact/Conclusion:
A. The Boardwalk Crossing at Mason Street, PDP - Final Plan, as previously approved,.
continues to comply with the applicable standards in ARTICLE 3 - GENERAL
DEVELOPMENT STANDARDS of the LUC.
B. The Boardwalk Crossing at Mason Street, PDP - Final Plan complies with the purpose of
the C District as it is an infill project, as part of a previously approved PDP under the
(LUC), which provides complementary and supporting land uses that serve the
community in general. As set forth in ARTICLE 4 - DISTRICTS, Division 4.21 -
Commercial District, offices and retail establishments are permitted in the C,
Commercial District, subject to an Administrative (Type 1) review. The future presence
of additional offices and retail establishments in this area remains a benefit to the
community. Staff recommends approval of the one (1) year extension request.
C. The Boardwalk Crossing at Mason Street, PDP - Final Plan is compatible with, and
complements, the surrounding land uses.
RECOMMENDATION:
Staff recommends approval of the Boardwalk Crossing at Mason Street, Project Development
Plan — One (1) Year Extension of Final Plan - #76-93C.

2. ARTICLE 2 - ADMINISTRATION
Section 2.2.11(D)(4) Extensions
This section states that extensions for two (2) successive periods of one (1) year each may be
granted by the Director, upon finding that the plan complies with all general development
standards as contained in Article 3 and Zone Districts Standards as contained in Article 4 at the
time of the application for the extension. Any additional one-year extensions shall be
approved, if at all, only by the Planning and Zoning Board, upon finding that the plan
complies with all applicable general development standards as contained in Article 3 and Zone
District Standards as contained in Article 4 at the time of the application for the extension, and
that the applicant has been diligent in constructing the engineering improvements required
pursuant to Section 2.2.11(D)(3) of the LUC, though such improvements have not been fully
constructed.
The Boardwalk Crossing at Mason Street, PDP - Final Plan on the subject property was
approved by the Director of Planning on October 5, 2005. The (Current Planning) Director has
previously granted one 2-year extension (instead of two successive 1-year extensions),
extending the Final Plan approval to October 5. 2010. An additional one-year extension must
now go to the Planning and Zoning Board for a decision. If granted the Final Plan approval
would be extended to October 5, 2011.
3. APPLICANT'S EXTENSION REQUEST
The Applicant's written narrative and supporting documentation for the Boardwalk Crossing at
Mason Street, PDP - Extension of Final Plan is attached to this Staff Report.
4. ARTICLE 3 - GENERAL DEVELOPMENT STANDARDS
The Boardwalk Crossing at Mason Street, PDP - Final Plan, as previously approved, continues
to comply with the applicable standards in ARTICLE 3 - GENERAL DEVELOPMENT
STANDARDS of the LUC.
5. ARTICLE 4 - DISTRICTS
A. Division 4.21 - Commercial District
Offices and retail establishments are permitted in the C, Commercial District, subject to an
Administrative (Type 1) review. The purpose of the C District is:
• Intended to be a setting for development, redevelopment and infill of a wide
range of community and regional retail uses, offices and personal and business
services. Secondarily, it can accommodate a wide range of other uses including
creative forms of housing.
While some Commercial District areas may continue to meet the need for auto -
related and other auto -oriented uses, it is the City's intent that the Commercial

COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:

The property was annexed as part of the Horsetooth - Harmony Annexation in July, 1978.
The subject property was platted as Lots 1 & 2 of the Boardwalk Crossing, Filing 2 — Minor
Subdivision that was approved by the Director of Planning on February 8, 1994. No
development plan was reviewed or approved at that time.
The Boardwalk Crossing, PDP on the subject property was approved by the Director of
Planning on January 14, 2005. The plan includes a 2-story, 10,000 square foot office/retail
building on Lot 1; a 1-story, 5,000 square foot retail building on Lot 2; and, 82 parking spaces
on 1.77 acres.
The Boardwalk Crossing at Mason Street, PDP - Final Plan on the subject property was
approved by the Director of Planning on October 5, 2005. The plan includes a 2-story, 10,000
square foot office/retail building on Lot 1, a 1-story, 5,000 square foot retail building on Lot 2;
and, 82 parking spaces on 1.77 acres.
The Current Planning Director approved, on May 8, 2008, a two (2) year extension to the
Boardwalk Crossing at Mason Street, PDP - Final Plan that was originally approved October 5,
2005. Based on this extension, all engineering improvements (water, sewer, streets, curb,
gutter, street lights, fire hydrants and storm drainage) must be completed no later than October
5, 2010. The Director is authorized to grant extensions only for two (2) successive periods of
one (1) year each. Any additional one-year extensions may be approved, if at all, only by
the Planning and Zoning Board.
