CrJ �q[, li ��/ ihA/t4 Signature: 0 1, 11" 1'c Date: t "1 13 Date I o f /I October 9, 2013 Cargill c/o Mr. Steve Stadelmaier, 2540 East Drake Road Fort Collins, CO 80525 Re: Letter of Intent for Proposed Spring Creek Farms North Filing No. 4 Development and its relation to the Existing Cargill Irrigation Lateral and Easement Dear Mr. Stadelmaier, The purpose of this letter of intent is to document our coordination with you in regards to the proposed Spring Creek Farms North Filing No. 4 proposed single family development and any impacts the development could potentially have on Cargill's existing 21" RCP irrigation lateral and associated easement that runs west -east along the north side of Nancy Gray Avenue. The proposed development does not intend to propose any changes or modifications to the existing irrigation lateral itself or the integrity of the lateral. However, Aspen has noted that the proposed development will entail proposed grading and roadway and utility infrastructure improvements to serve the development crossing over and under the existing irrigation lateral. Aspen's preliminary -engineering plans provide for a residential local street (Adobe Drive- roadway running north -south through the development) crossing over the existing irrigation line, with proposed 8" sanitary sewer and 8" waterline crossing under the existing 21" RCP irrigation lateral. Aspen's preliminary grading plan shows a cut below existing grade of approximately 2.0' in the area of the existing line. The resulting cover over the existing irrigation line will be approximately 2.5', as shown on sheet C-013 of the preliminary engineering plans. I This letter of intent serves as record of the design effort and communication produced to date, and does not signify acceptance of the improvements in relationship to the existing irrigation lateral and associated easement. Aspen will continue to work with Cargill on design items related to the existing irrigation lateral with final engineering design of the proposed utility plans and provisions to protect and uphold the integrity of the existing irrigation lateral and the associated easement within the Spring Creek Farms North Filing No. 4 project requiring final approval from Cargill, through Cargill's signature on the fnil utility plan cover sheet.
