a. We understand that the Council granted a five year phase in at 20 percent per year
when some southwest neighborhoods were annexed.
b. Their phase -in reached the full storm water fee rate in year five after annexation.
Solution:
1. In recognition of:
a. The significant Clydesdale Park lot owner contribution to the condition of the
public improvements which the City will manage at the time of annexation,
b. The significant PID fund balance which will be transferred to the City at the
time of annexation when the lot owners begin paying City property taxes, and
C. The economic impact on residents of paying City property taxes simultaneous
to this transfer of the PID balance to the City,
2. Grant Clydesdale Park lot owners a five year storm water utility fee phase -in at
the time of annexation. Start at 20% of the rate the first year after annexation
and increase the amount by 20% of the rate each following year until full
payment is reached in year five (5) after annexation.
We respectively request that the City of Fort Collins grant a phase -in of the storm water fee at
the time Clydesdale Park is annexed into the City. We appreciate your consideration of our
request and ask for your support through a recommendation to City Council.

Subject: Rationale for a phase in of the storm water fee for Clydesdale Park
Dear Board,
1. City code (sec. 26-514) permits City Council to temporary reduce the storm water
utility fee at the time of annexation. (bold italic added for emphasis)
a. Sec. 26-514 (b) states: "In the event that the City Council has determined at the
time of annexation of a lot or parcel of land that the temporary reduction of the
storm water utilityfee is justified in order to mitigate the economic impact to the
annexed properties in light of the relevant circumstances, the storm water utility
fee applicable to said lot or parcel may be temporarily reduced by the City Council
pursuant to the schedule set forth in the ordinance annexing said parcel or lot.'
2. Clydesdale Park voters approved a Public Improvement District (PID 50) in
November of 2012 and that PID has made significant road improvements.
a. The PID levies a 16.258 mil. property tax on all Clydesdale Park lots.
b. The PID funds may only be used to maintain public improvements in the road
right of way.
c. In an effort to maintain the roads in high quality, the PID, in collaboration with the
Larimer County Engineering Department, spent about $9 thou. in 2012 to crack -
seal the roads.
d. As part of the Clydesdale Park annexation considerations, the Fort Collins road
department surveyed the Clydesdale Park roads in late 2013 or early 2014 and
concluded that the roads met city standards.
e. In an effort to upgrade the roads, the Clydesdale Park PID, again in collaboration
with the Larimer County Engineering Department, spend $143 thou. in June 2014
to chip seal all the roads in Clydesdale Park.

This letter acknowledges receipt of the Petition for the above proposed annexation to the
City of Fort Collins. This week, staff from the Larimer County Planning, Engineering
and Health Departments met to review these materials.
Larimer County Community Development (Planning) would like the City of Fort Collins
to consider annexing Waterdale Mobile Home Park and Vista Grande Planned
Development, as well as E Mulberry St to the north.

3. Demonstrate the City's development decisions are dependable: Clydesdale Park
developers singed a pre -annexation agreement with the City in 2001. Larimer County
required the neighborhood be developed to City standards and would have not
approved the residential development without the expectation of annexation.
Residents bought their homes expecting annexation. Clydesdale Park could have been
annexed ever since 2005 when the Fox Grove property which boarders Clydesdale
Park was annexed into the City. If the City wants developers, residents, and partners,
such as Larimer County, to act in concert with the City's planning objectives, the City
needs to follow through on its development commitments, commitment such as this
annexation.
4. Simplify the Fox Grove development approval process: Carriage Parkway is the
only road access into Fox Grove until Carriage Parkway is extended south to Prospect
Road. Carriage Parkway through Clydesdale Park is currently maintained by
Clydesdale Park residents. Clydesdale Park residents should not be required to
maintain roads which the Fox Grove residents use. Annexation will solve this road
maintenance issue with the City taking over maintenance of the road. All Clydesdale
Park roads were built and have been maintained to City standards. Clydesdale Park
residents will understandably be very vocal about the City's failure to follow-through
on its annexation commitment if Clydesdale Park is not annexed when the final Fox
Grove development plans are approved.
We respectively request that the City of Fort Collins annex Clydesdale Park into the City. We
believe that the City may do this using the Annexation Agreement signed in 2001, so no
further formal request process from the Clydesdale Park homeowners is necessary.
We look forward to your consideration and ask your support of our request to be annexed into
the City of Fort Collins.

Subject: Rationale for annexing Clydesdale Park into the City of Fort Collins
Dear Board,
Clydesdale Park residents and lot owners want to be annexed.
1. Annexation petition: The Home Owners Association circulated a petition among
residents and lot owners to assess support for annexation.
2. Owners of 72% of lots signed requesting annexation: By an overwhelming
majority, the residents and lot owners in Clydesdale Park signed a petition requesting
annexation. Owners of 156 (72 percent) of the 217 lots in Clydesdale Park signed the
petition requesting annexation by Fort Collins.
3. Owners of 90% of those responding want annexation: A more telling indication of
resident interest is that owners of 90 percent of the lots who responded to the petition
signed it requesting annexation by Fort Collins. Copies of those petitions can be
provided to the Board.
Annexation has several advantages to the City.
1. Better control development in the I25/Mulberry gateway: Annexation will
consolidate and better control development around the I25/Mulberry gateway into the
City, thereby ensuring that development complements the City's gateway
development plan.
2. Better control traffic flow near the I25/Mulberry gateway: Carriage Parkway from
Mulberry down to the proposed Fox Grove development is currently maintained by
the Clydesdale Park residents through a PID and managed by Larimer County. South
of Clydesdale Park, Carriage enters City -annexed land and will eventually be extended
south to Prospect Road. Management of the entire Carriage Parkway collector road
will help the City better control gateway traffic.

In order to gain the 1/6 contiguity with a municipal boundary as required by state law, a series
of two annexations are needed to annex the Clydesdale Park neighborhood. The Clydesdale
Park First Annexation gains the required 1/6 contiguity to existing city limits from a common
boundary with the City of Fort Collins through the Fox Grove property to the west, which was
annexed in 2005. The Clydesdale Park Second Annexation gains the required 1/6 contiguity to
existing city limits from a common boundary with the Clydesdale Park First Annexation, thus
satisfying the requirement that no less than one -sixth of the perimeter boundaries be
contiguous to the existing city boundary.
Staff recommends that this property be included in the Residential Neighborhood Sign District,
which was established for the purpose of regulating signs for non-residential uses in certain
geographical areas of the City that may be particularly affected by such signs because of their
predominantly residential use and character.
PUBLIC OUTREACH:
Planning staff has coordinated with the residents of Clydesdale Park over the past year to
explain the annexation process and answer questions about how annexation into the City will
affect the neighborhood's taxes, fees, street maintenance and services. A letter from the
Clydesdale Park Homeowner's Association in support of annexation is attached.
FINDINGS:
The Clydesdale Park Annexations are consistent with the policies and agreements
between Larimer County and the City of Fort Collins as contained in the amended
Larimer County and City of Fort Collins Intergovernmental Agreements.
2. The annexation area meets the eligibility requirements included in State law to qualify for
a voluntary annexation to the City of Fort Collins.
3. The requested zone district, L-M-N, Low Density Mixed -Use Neighborhood, is in
compliance with the City of Fort Collins Structure Plan and with the policies of the City's
Comprehensive Plan.

amount of contiguity to the city limits to meet state requirements. This is the case with
Clydesdale Park. When the Clydesdale Park subdivision was planned and approved, it could
not be annexed into the City because it did not share a common boundary with the city limits at
the time. Now that a common boundary does exist, the City may now initiate the annexation
process through the Annexation Agreement.
The approval of the annexations will enable the neighborhood's streets, including Carriage
Parkway, to be accepted into the City of Fort Collins' Street Maintenance Program. Clydesdale
Park's streets are currently maintained by the residents of Clydesdale Park through their Public
Improvement District (PID). The establishment of the PID was necessary because Larimer
County does not typically maintain roads that are developed as part of a residential subdivision.
Carriage Parkway currently dead -ends at the southwest corner of the neighborhood and carries
traffic predominantly for Clydesdale Park's residents. With the new Fox Grove residential
development proposed to the southwest, within the city limits, it now seems imminent that this
parkway will be extended and serve as access for additional residents who have no obligation
to pay into the Clydesdale Park PID.
Residents have expressed concern that their continued maintenance responsibility for the
existing portion of Carriage Parkway is no longer reasonable if the parkway is extended and
used by future development to the south. Carriage Parkway is designated as a collector street
on the City Master Street Plan, and will eventually be extended south to East Prospect Road.
All portions of the future Carriage Parkway extension are within the city limits and will therefore
be maintained by the City once constructed and accepted. Because all of Clydesdale Park's
streets are currently in good condition, the City Streets and Engineering Departments are in
agreement that the streets can be accepted into the City of Fort Collins' Street Maintenance
Program, should the annexations be approved.

These annexation requests are in conformance with the State of Colorado Revised Statutes as
they relate to annexations, the City of Fort Collins Comprehensive Plan, and the Larimer
County and City of Fort Collins Intergovernmental Agreements.
These annexations are located within the Growth Management Area (GMA). According to
policies and agreements contained in the Larimer County and City of Fort Collins
Intergovernmental Agreements, the City will agree to consider annexation of property in the
GMA when the property is eligible for annexation according to state law.
On September 2, 2014, City Council will consider an Initiating Resolution to accept the
annexation petition. The resolution also initiates the annexation process for the property by
establishing the hearing dates for two readings of the ordinances annexing and zoning the area.
The Board's recommendation for this annexation will be forwarded to City Council as part of a
proposed First Reading of the annexation and zoning ordinances on October 7, 2014.
BACKGROUND:
The Clydesdale Park development was approved by the Larimer County Board of
Commissioners in 2001. In accordance with Larimer County's standard development approval
procedures, an Annexation Agreement was recorded with the original development approval.
This Annexation Agreement is typically required during the County development review process
to facilitate annexations that may happen sometime in the future that don't have the requisite
