Topic: Easements Comment Number: 4 Comment Originated: 10/092013 10/09/2013: The offsite legals and exhibits emailed on 9/11 generally look acceptable with a couple of comments: 1) I'm assuming these will all be dedicated to the City using the City's standard form, if viewed otherwise, we should discuss 2) The "Temporary construction and grading" I think leaves ambiguity on whether the grading is also temporary or permanent. If only the construction is meant to be temporary, it may read better as a grading and temporary construction easement. 3) Our standard language does not address "temporary" easements, whether for construction, grading, or both. If the intent is to have the construction (and grading) expire, we may need to look further at how this process occurs, whether if by language in the easement or through a separate vacation process later on (which requires a $400 fee to vacate each easement). 4) The requirement of cross sections for Timberline Road mentioned below may show the need for additional construction and grading easement along Timberline north of the development. We may need a permanent slope easement also as a designation for this easement. 5) The legals for the easements/rights-of-way have not been checked by Technical Services yet for closure. I'm comfortable with them starting this process now, except for the construction and grading easement along Timberline Road, pending additional review of grading and cross sections. 6) Each deed of dedication requires a $250 TDR fee. In addition, Larimer County recordation fee: will be assessed once the number of pages is known. Acknowledged. Temporary Construction and grading easements are acceptable, per meeting with Marc Urata Topic: General Comment Number: 2 Comment Originated: 10/092013 10/09/2013: Red Willow Drive would need to be shown on the Master Street Plan as a collector roadway approved by City Council in order for it to be eligible for street oversizing reimbursement. If this has not yet occurred, coordination with Transportation Planning is needed, as the adoption of this roadway as a collector would need to occur prior to approval of the Final Plan. It is likely that Red Willow Drive cannot then be the street name as collector roadway names are also approved through Council. Per the Master Street Plan dated Sept 3, 2013, this street is shown as a collector and is labeled as Red Willow Drive. The culvert(s) shown at Fossil Creek Parkway on the plan and profile sheets don't clearly show the extension of a concrete channel in the parkway strip. These have been labeled appropriately. Comment Number: 8 Comment Originated: 10/092013 10/09/2013: Roadway plan and profile sheets need to show existing and proposed contours on the plan view for better review and verification on how road designs tie into existing grades and further evidence that proposed offsite easement legal descriptions are sufficient. Comment Number: 9 Comment Originated: 10/092013 10/09/2013: Grading plan sheets don't show the area further north along Timberline for the roadway widening and south of the site for the work along Linden Park. Additional grading plan sheet(s) showing the offsite grading along Timberline to the north and to the south should be provided. Comment Number: 10 Comment Originated: 10/092013 10/09/2013: On Sheet C-033, the private irrigation line crossing Rosen Drive does not meet the minimum 3 feet of cover over the roadway and would need to be modified. Also on this sheet, the private irrigation line profile view needs to be carried out to the connection point within the widened Timberline Road to verify pipe cover over roadway. The irrigation line has been lowered to provide 3 ' of cover and a profile added for the line extension to the east.
