College Ave. PO Box 580 Fort Collins, CO 80522-0580 970.221.6750 970.224.6134 - fax fcgov.com/Currentp/anning RE: Condition of Approval - Bucking Horse Multi -Family, Fourth Filing Bucking Horse Multi -Family, Fourth Filing, is a replat of portions of Sidehill Filing Two, Bucking Horse Filing One, Bucking Horse Filing Two and Bucking Horse Filing Three. These previous filings included dedications of public rights -of -way that are no longer needed in their currently platted configuration. Consequently, these existing dedications of public rights -of -way need to be vacated which can only be done by City Council. In order to ensure that the City does not begin the vacation of public right-of-way prematurely, in case the developer terminates the application, the vacation procedure is done only at the time that the City is satisfied the development proposal is close to, being approved for Final Plan. (Note that the City Council action is not valid until the new replat is filed.) Staff recommends the following condition of approval to establish a clear expectation that the vacation of public rights -of -way. Prior to approval of the Bucking Horse Multi -Family, Fourth Filing, Final Plan the City Council must have completed the vacation of the public rights -of -way that are no longer needed to serve the public as a result of the alternative circulation pattern and public access easements as shown on the Final Plan.
