ment area for the purpose of exercising the
rights therein granted; and
(d) That certain Deed dated March 22, 1960
from Union Pacific Railroad Company to Earl
R. Wilkinson, R. L. Osborn, John E. Mangum
and Don H. Niewald, identified in the records
of Grantor as C.D. No. 44918-2, Audit No.
2968, covering a PERPETUAL EASEMENT for road-
way purposes over and across certain land,
including a portion of the southerly twenty
feet (20.0') of the land described in
Exhibit A.
It is expressly understood that the subjacent sup-
port of the premises hereby conveyed may have been impaired
by mining operations heretofore carried on beneath the
surface thereof, and the sale and conveyance of said premises
is upon the condition that Grantor, its successors and
assigns, sball not be liable for damages resulting therefrom.
TOGETHER with all and singular the hereditaments
and appurtenances thereunto belonging, or in anywise apper-
taining, and the reversion and reversions, remainder and
remainders, rents, issues ind profits thereof; and all the
estate, right, title, interest, claim and demand whatsoever
of Grantor, either in law or equity, of, in and to the above -
bargained premises, with the hereditaments and appurtenances,
except, however, as aforementioned.
To HAVE AND To HOLD, subject to the aforesaid ex-
ceptions, reservations and other provisions, the said prem-
ises above bargained and described in Exhibit A, with the
appurtenances, unto Grantee, its successors and assigns,
forever. And Grantor, for itself, its successors and assigns,
does covenant, grant, bargain and agree to and with Grantee,
its successors and assigns, that at the time of the ensealing
and delivery of these presents it is well seized of the prem-
ises above conveyed, as of a good, sure, perfect, absolute
and indefeasible estate of inheritance in law, in fee simple,
and has good right, full power and lawful authority to grant,

corporation duly organized and existing under and by vir-
tue of the laws of the State of Nebraska, Grantor, and
L t W SUPPLY CORPORATION, a corporation duly organized
and ezisting under and by virtue of the laws of the State
of Delaware, whose legal address is 101 South Wacker,
Chicago, Illinois 60606, Grantee:
WITNESSETH, That Grantor, for and in considera-
tion of the sum of Sixty -Eight Thousand one Hundred Sight
Dollars ($68,108.00) to Grantor paid by Grantee, the re-
ceipt whereof is hereby confessed and acknowledged, has
granted, bargained, sold and conveyed and by these pres-
ents does grant, bargain, sell and convey unto Grantee,
its successors and assigns, forever, the parcel of real
estate situate in the Northeast Quarter (NE 1/4) of
Section 2, Township 7 North, Range 69 West of the Sixth
Principal Meridian in the City of Port Collins, Larimer
County, State of Colorado, described in Exhibit A hereto

As pursuant to Section 24-65.5-103 of the Colorado Revised Statutes, we wish to notify
that a building will be built to replace an existing building on the property known as 300 Hickory
Street, Fort Collins, Colorado.
You are being notified because you are the Owner, of record, of subsurface mineral
rights on said property. Although this construction should not affect your rights, it is now
required to give you notice of the proposed development of the surface area.
Find included copies of the Warranty Deed (Larimer County #961893) explaining the
mineral rights agreed to, and a plat of the surface development, for your records.
