Tom,
With regards to the Storybook, 2nd Filing development plan it is determined that the first phase
of this filing is valid and vested. Therefore, permits could be issued and homes built on Lots 1 —
45 and 68 — 76. These lots all front on Maid Marian Court, Friar Tuck Court, Chesapeake Drive
or Deep Woods Lane. Lots 41 — 45, although in the second phase, front on the north side of
Chesapeake Drive, which is constructed, and assumedly have utilities stubbed to them. If so,
then they are valid. Due to a significant time lapse since construction, some repairs and/or
improvements are necessary and must be made to these streets, curb & gutter, sidewalks or other
improvements that were previously made with the first phase.
The second phase of this development has expired (and is null & void) because "substantial
completion" as set forth in Section 2.2.11(D)(3), vesting the right to develop, has not been
accomplished. A portion of Deep Woods Lane and all of Sherwood Forest Court in the 2nd
Filing (east of Little John Lane) have not been built. Other improvements such as utilities are
unlikely to have been installed, as well. The lots affected, and expired, in the second phase are
46 — 67. Because this portion of Storybook, 2nd Filing has expired it will be necessary for any
proposed development on the property to go through the City's Project Development Plan (PDP)
and Final Development Plan review processes. A public hearing is required for the PDP.
Attached is an aerial photo of the Storybook development that shows you what street
improvements have not been completed. Please let me know if I can be of further assistance on
this matter.
