FINDINGS OF FACT AND DECISION
In reviewing and evaluating this Project Development Plan and all supporting reports, plans,
maps, and other documentation; testimony given at the public hearing; and the staff analysis
and report, the Hearing Officer makes the following Findings of Fact and Decision:
1. The Project Development Plan complies with all applicable administrative standards
contained within Article 2 of the City's Land Use Code.
2. The Project Development Plan complies with all applicable General Development Standards
contained in Article 3 of the City's Land Use Code, specifically Section 3.8.13 Wireless
Telecommunication.
3. The Project Development Plan complies with all applicable district standards of Section 4.24
of the City's Land Use Code, for the C-L—Limited Commercial District.
Decision: The Verizon Wireless at 1052 West Vine Drive, Project Development Plan #120025 is
hereby approved on February 1, 2013.

SUMMARY OF HEARING OFFICER CONCLUSIONS
NOTICE OF PUBLIC HEARING
Evidence presented to the Hearing Officer established no controversy or facts to refute that the hearing
was properly posted, legal notices mailed, and notice published.
PUBLIC HEARING January 30, 2013
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at
approximately 5:00 P.M. on Wednesday, January 30, 2013 in Conference Room A, 281 North College
Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE
The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff
Report; (2) application, plans, maps and other supporting documents submitted by the applicant and
applicant's representative(s) to the City of Fort Collins; (3) a sign-up sheet of persons attending the
hearing on January 30, 2013; and (4) a tape recording of the hearing. The Land Use Code, the City's
Comprehensive Plan (City Plan) and the formally promulgated policies of the City are also considered
part of the evidence considered by the Hearing Officer.

This is a request for the construction of a new wireless telecommunication tower and equipment shelter
at 1052 West Vine Drive. The site is located north of West Vine Drive and east of North Shields Street,
situated north of the Gasamat Gas Station and Apex Gutter. The proposed wireless telecommunications
tower is a 75 foot stealth "monopine" designed to mimic a ponderosa pine tree. A six foot wood
screening fence will surround a pre -fabricated equipment shelter at the base of the "monopine." The
site is zoned C-L, Limited Commercial District and wireless telecommunications facilities are permitted
subject to an Administrative (Type 1) review and public hearing (Land Use Code, Section 4.24(B)(2) in
this zone district.
