Section 4.24(D)(1) Building Height. The maximum building height for the Limited Commercial District is 3 stories. Additionally, the Land Use Code defines a story to be up to 25' in height. As proposed, the wireless telecommunication facility is 75 feet tall, not exceeding the 3-story, 75 foot height maximum. FINDINGS OF FACT / CONCLUSIONS: After reviewing the Verizon Wireless at 1052 West Vine Drive Telecommunication Facility, Project Development Plan - #120025, staff makes the following findings of fact and conclusions: 1. The Project Development Plan complies with all applicable administrative standards contained within Article 2 of the Land Use Code. 2. The Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code. 3. The Project Development Plan complies with all applicable district standards of Section 4.24 of the Land Use Code, C-L—Limited Commercial District. RECOMMENDATION: Staff recommends approval of the Verizon Wireless at 1052 West Vine Drive Wireless Telecommunications Facility, Project Development Plan - #PDP120025. ATTACHMENTS: ■ Vicinity Map • Plan set ■ Colored Elevations ■ Photo -simulations ■ Real -World Photo Examples Page 6 of 8 Verizon Wireless at 1052 West Vine Drive, PDP January 30, 2013 the time of planting the trees are comprised of 4 Rocky Mountain Junipers 6 feet in height and 2 Ponderosa Pine trees 12 feet in height. The chosen landscaping was based on the intent to screen the cedar fencing and equipment shelter as well as to provide a natural grouping of coniferous trees the proposed "monopine" tower disguised as a ponderosa pine could blend into. v. Fencing: A 6 foot solid cedar fence is proposed to enclose the ground equipment. vi. Lighting: One light is proposed at the site and will comply with the requirements of a high pressure sodium light source that is down - directional with sharp cut-off luminaries. vii. Interference: The proposed facility will not interfere with other types of electronics or wireless providers: If there are problems, the Applicant will be responsible for repairing the equipment. viii. Access Roadways: The property takes access off of West Vine Drive. Adequate emergency access is provided through a 20 foot emergency access easement meeting the needs of response equipment for Poudre Fire Authority. ix. Foothills and Hogbacks: This proposal is not in or near the foothills. x. Airports and Flight Paths: The proposed "monopine" is not located near an airport or within a flight path. A. Historic Sites and Structures: The proposed equipment is not located on a historic structure, nor is the site located within a historic district. xii. Stealth Technology: The communications tower is designed as a stealth "monopine," made to resemble a real ponderosa pine tree. The resin branches of the "monopine" will conceal the wireless antennas and are much less visually intrusive than traditional, unscreened triangular antenna arrays. This ponderosa pine disguise has been successfully used elsewhere and real -world photo examples have been provided from other locations. 4. Article 4 — Districts Division 4.24 of the Land Use Code, C-L, Limited Commercial Zone District Wireless telecommunication facilities are permitted in the Limited Commercial Zone District subject to an administrative (Type 1) review and hearing. Neighborhood Scale: Though the proposed "monopine" tower is not similar to the mass and scale of the single family residences to the south, the stealth technology, disguising the telecommunications tower as a ponderosa pine is compatible and similar to existing mature landscaping in the general vicinity. The disguised ponderosa pine telecommunications tower is designed so as not to be more obtrusive than a similarly mature ponderosa pine tree. v. Land Use Transition: This proposal may be considered to represent a different visual character than the adjacent uses. Given that a gradual transition is not possible, the development plan shall, to the maximum extent feasible, achieve compatibility through adhering with the rest of the standards of this section, including color and landscaping. B. Section 3.8.13, Wireless Telecommunication 1) Location and Co -location [Section 3.8.13 (A) and (B) - The wireless telecommunication equipment is proposed to be ground mounted within the C-L—Limited Commercial District. The Applicant made a good faith effort to co -locate with existing facilities in the vicinity with no success. If approved, the Applicant may not prevent future telecommunication carriers from further co -locating upon this structure. 2) Standards [Section 3.8.13 (C)] — Setbacks: The 75 foot "monopine" tower is setback more than the required one foot for every foot of height requirement at the two closest points to the property line; the setback from the western property line on North Shields Street is 141 feet and the setback from the southern property line is 87 feet. ii. Wireless Telecommunication Facilities: The proposed "monopine's" resin branches will exactly match the color of a real ponderosa pine tree. The equipment at ground level will be earth -toned and pebble -textured and screened by a six foot cedar fence and the planting of six coniferous trees to minimize visual impacts. iii. Wireless Telecommunication Equipment: As noted above, the "monopine" will be disguised as a ponderosa pine to minimize visual impacts. iv. Landscaping: The applicant is proposing to plant six coniferous trees in a. semi -circle configuration adjacent to the 6 foot cedar screening fence from the southwest to northwest facing comers. At Page 4 of 8 Verizon Wireless at 1052 West Vine Drive, PDP January 30, 2013 located in Division 2.2 — Common Development Review Procedures for Development Applications; and Division 2.4 — Project Development Plan. 3. Article 3 — General Development Standards The Verizon Wireless Telecommunication Facility at 1052 West Vine Drive, Project Development Plan, complies with the applicable requirements of the Land Use Code, including those located in Division 3, General Standards. A. Section 3.5.1, Building and Project Compatibility 1) Purpose [Section 3.5.1 (A)] - The purpose of the building standards section is to ensure that the physical and operational characteristics of proposed buildings and uses are compatible when considered within the context of the surrounding area. This proposal meets the compatibility standards as noted below. 2) Color [Section 3.5.1 (F)] - The proposed equipment shelter will be earth tone and pebble -textured and the resin branches and trunk of the stealth communications tower disguised as a ponderosa pine will exactly match the color of a real ponderosa pine tree. 3) Building Height Review [Section 3.5.1 (G)] - Special Height Review/Modifications: The section establishes a special review process for buildings or structures which exceed 40 feet in height. The applicant has submitted required photo -simulations which are attached. The proposed wireless facility meets the review standards including: i. Views: The tower is proposed to be located near the southwestern edge of the property along North Shields Street. Views of the foothills would be from the eastern side of the currently vacant lot. The stealth "monopine" would not greatly impact these views. A grouping of large, mature trees partially obscures views of the mountains immediately west of the project site across North Shields Street. ii. Light and Shadow: The proposed trunk of the "monopine" is approximately three feet in diameter and 75 feet tall with simulated ponderosa pine resin branches beginning fifteen feet above the base and extending to the full height, narrowing near the top. Shadows cast from this structure are not substantial enough to have an adverse impact on neighboring properties. iii. Privacy: As the proposed tower is not habitable, no privacy issues will result. Background The surrounding zoning and existing land uses are as follows: N: Outside City Limits & POL — Public Open Lands (McMurry Natural Area) E: CL — Limited Commercial (Farm Utility Buildings & Single Family Homes) S: LMN, NCM & NCL— Low Density Mixed -Use Neighborhood District, Neighborhood Conservation Medium Density District & Neighborhood Conservation, Low Density District (existing multifamily and single family residential neighborhoods) W: CL & LMN — Limited Commercial & Low Density Mixed -Use Neighborhood District (Animal Shelter/Grooming & existing multifamily and single family residential neighborhoods) Historically, the property (Parcel #s 97023-40-002 & 97023-40-001) was annexed into the City in August of 1995 as part of the Snyder Annexation; both parcels are platted. The property is owned by Donald Rein, Dorothy Rein, and Michael Rein and the southern parcel (Parcel # 97023-40-002) is the site of the Apex Gutter Co. Opportunities for collocation in the area are limited due to the residential nature of the surrounding area and no nearby structures of sufficient height available for rooftop placement. Verizon Wireless did attempt to collocate with T-Mobile on a new, canister tower wireless telecommunications facility across the street ("Animal House") at 1108 West Vine Drive, but the tower's height was insufficient for coverage. Further, the approved T-Mobile canister tower at 1108 West Vine Drive has not yet been constructed. The proposed wireless facility is a stealth "monopine" telecommunications tower disguised as a ponderosa pine tree. The first staff review meeting was held on October 17, 2012. A second round of staff review was held on January 2"d, 2013. The applicant has submitted a visual analysis, including photo -simulations of the "monopine" tower, which are attached. The Federal Telecommunications Act of 1996 restricts municipalities' ability to deny telecommunications equipment installations. A municipality may not deny a wireless facility because it does not want such development in the community or because of concerns about negative health consequences from radiation emitted by wireless facilities. Cities can stipulate in which zone districts wireless facilities are permitted. Fort Collins allows wireless telecommunications facilities only in zone districts which are primarily commercial, industrial or in public open lands. 2. The site is located north of West Vine Drive and east of North Shields Street, situated north of the Gasamat Gas Station and Apex Gutter. The proposed telecommunications tower is a 75 foot stealth "monopine" designed to mimic a ponderosa pine tree. A six foot wood screening fence will surround a pre -fabrication equipment shelter at the base of the "monopine." The site is zoned C- L, Limited Commercial District and wireless telecommunications facilities are permitted subject to an administrative (Type 1) review and public hearing (Land Use Code, Section 4.24(B)(2)) in this zone district. RECOMMENDATION: Approval EXECUTIVE SUMMARY: Wireless telecommunication facilities are permitted in the C-L, Limited Commercial District, subject to an administrative hearing. The Project Development Plan (PDP) complies with the applicable Administrative and General Development standards and the C-L, Limited Commercial District Standards.
