HomeMy WebLinkAboutHACIENDA HIGGINS-MARQUEZ - PDP/FDP - FDP120022 - SUBMITTAL DOCUMENTS - ROUND 1 - MODIFICATION REQUESTWilliam Higgins 8571 Secretariat Dr Wellington CO 80549 RE: Modification of Standards Request December 10, 2012 For the purpose of building our home at 1717 W Mulberry we would propose to modify the front setback and building height noted in the Fort Collins Land Use Code Section 4AD below; (D) Land Use Standards. (.1) Density. All development in the Low Density Residential District shall have a minimum lot area the equivalent of three (3) times the total floor area of the building but not less than six thousand (6,000) square feet. (2) Dimensional Standards. (a) Minimum lot width shall be sixty (60) feet for a single-family dwelling or child-care center and one hundred (100) feet for all other uses. (b) Minimum setback of the front yard shall be twenty (20) feet. (c) Minimum setback of the rear yard shall be fifteen (15) feet, except that the minimum setback of alley - accessed garages shall be six (6) feet. (d) For residential uses, the minimum side yard width shall be fifteen (15) feet on the street side of any corner lot and five (5) feet for all interior side yards. For all other uses, the minimum side yard width shall be the equivalent of one (1) foot for each three (3) feet or fraction thereof of building height, provided that for school or church uses no side yard shall be less than twenty-five (25) feet wide. (e) Maximum building height shall be twenty-eight (28) feet for a single-family dwelling, accessory building, group home or child care center and three (3) stories for all other uses. We would request that the front setback be lowered to a requirement of 15 feet from the extended 42' right of way from the center line of Mulberry In addition that the building height be allowed to increase to 30' to accommodate the Craftsman design that has been chosen for the project and to allow for a slight elevation increase due to hard and expansive soil conditions. This proposed change would be categorized as nominal/inconsequential as the increase is not a large amount and will not affect the surrounding properties. In addition the extra right away that is required for future expansion of Mulberry leaves a small building envelope for the property to be built on in order to accommodate a side load garage off of Cook Street. i William Higgins 0-658-0279
