b) the ODP will reserve a commuter bicycle path along the west side of the Fossil Creek Inlet
Canal to be built, owned and maintained by the City of Fort Collins;
c) it is noted that any bicycle path along existing County Road 9 shall be separated from
roadway.
7. Engineering Department:
a) added to the ODP, Overall Utility Plan, and Overall Grading Plan the connection of the
proposed County Road 9 and the existing Drake Road to the Wastewater Treatment Facility
and Environmental Learning Center.
b) what happens to existing Drake Road and County Road 9 with the realignment of County Road
9 is a PDP issue and is noted;
c) the Wastewater Treatment Facility has been labeled on the ODP.
8. Zoning:
a) the Retail in the M-M-N has been changed to Convenience Retail Store without fuel sales;
b) noted that an overall minimum average density of 5 dwelling units per acre is required for L-
M-N, ODP shows gross density.
9. Natural Resources:
a) boundary definition noted;
b) Developer has agreed to an average 100' + open space buffer along each side of the Foothills
Basin Channel with a minimum 50' wide open space buffer along each side, proof of burden
for justification will be at the PDP stage by the developer for all open space buffer less than
100' and greater than 50' to achieve the 100' + average.
10. Poudre Fire Authority:
a) comments noted for the PDP.
11. Park Planning:
a) the City of Fort Collins and the developer will cost share the construction of the Foothills
Basin Trail;
b) Foothills Basin Trail will be 10' wide concrete;
c) City of Fort Collins will own and maintain the Foothills Basin Trail;
d) developer will work with Park Planning on exact location of the Foothills Basin Trail,
determination of the side of the Channel will be determined at PDP;
e) comments about Neighborhood Centers and Parks will be owned and maintained by the Home
Owners Association and will be noted on the PDP and ODP;
f) park fees will be collect for each dwelling unit for the development of Stewart Case Park.
12. Forestry Department:
a) noted that future submittals will address tree mitigation.
13. Current Planning:
a) bubbles on the ODP along the Foothills Basin are drawn at 50' minimum.and a note
addressing the average of 100'+ buffer along the Foothills Basin has been added to the ODP;

Revisions to the ODP
Dear Troy:
Based upon your comments of March 4, 1999, please note the following:
1. Water and Sewer Utility Department:
a) noted, new EPA regulations concerning the Waste Water Treatment Facility and the potential
notice to surrounding property owners;
b) Overall Utility Plan General Note #15 has been revised as per Roger Buffington.
2. Stormwater Utility Department:
a) see attached letter to Glen Schlueter;
b) J.R. Engineering met with Stormwater Department;
c) J.R. received comment sheet.
3. Traffic Operations:
a) Custer Drive issues have been resolved with and additional Signal Progression Study supplied
by Matt Delich;
b) lane and median comments noted for PDP.
4. Public Service:
a) the potential power line and gas line conflicts at the corner of Timberline and Drake Roads
have been noted;
5. Streets Department:
a) Added a note to the ODP and in the Planning Objectives that states the Home Owners
Association and/or Business Owners Association will be responsible for snow removal on
sidewalks along Drake and Timberline Roads, and any bicycle and pedestrian trails not
dedicated to the City of Fort Collins.
6. Transportation Planning:
a) The Traffic Impact Study has been amended to address the pedestrian and bicycle connections
to the Poudre.River Trail and the Environmental Learning Center;
