This letter is to clarify your questions on the ODP resubmittal issues.
1) The neighborhood park cannot be city owned. The city has already planned a
regional park in the vicinity, and it was assumed when they sized the park that the
monies from the Rigden Farm site (when developed) would go to build and maintain
that park. The Park Planning Department has no plans for any publicly owned parks
within your development. You are however still required to satisfy the park spacing
requirement at the PDP stage as stated in Section 4.4(D)(7) of the LUC where it
states, "either a neighborhood park or a privately owned park, that is at least one acre
in size shall be located within a maximum of one-third of a mile of at least ninety
percent of the dwellings in a development project as measured along street frontage."
2) The Limits of Development (LOD) is a PDP issue.
3) The vacation of existing County Road 9 is not an ODP issue. It is only a PDP issue to
the extent that you need to be aware of it. The city engineering department must
instigate the street vacation process.
4) The sidewalk connection that Kathleen mentioned along Drake, west of Rigden
Parkway is a Phase 1 PDP issue.
5) I'd like to set up a meeting next Monday 3/22 at 9a.m. here at 281 N. College with
Kathleen Reavis from Transportation, Janet Meisel from Park Planning, Basil
Hamdan from Stormwater, myself, you and Dave Pietenpol. I think this it is the best
way to resolve the bike path issue.
6) You are tentatively on the agenda for the April 15" P&Z hearing. I need your
compete resubmittal of all outstanding issues by Monday 3/22 to stay on schedule for
the hearing. You might make up two scenario drawings, one with the trail and one
without, and resubmit the appropriate one after the Monday morning meeting.
