least every 660'. Eric Bracke doesn't support this for safety issues of sight
distances on that curve. To address this issue you need to spell out an alternative
compliance to this code requirement in the general notes of the CDP. We would
like you to show the bike/pedestrian dotted line connecting at least every 660'
along the inside of that curve.
d. Label a potential intersection location on Timberline midway between Custer
Drive and Drake Road.
e. See redlined plans for density calculation comments.
We will require at least one round of revisions. Be sure and return all your redlined plans
and reports when you resubmit.

c. The location of the wastewater treatment plant must also be shown and labeled on
the CDP. You may need to decrease the scale or split the ODP onto two pages to
accomplish this.
d. Detailed Engineering comments will be provided to you as soon as they are

8. Zoning:
a. Seethe attached Zoning comment sheet.
9. Natural Resources:
a. According to Rob Wilkinson's notes for a meeting he had with Dave Peitenpol
and Vaughn Furness on 8/11/98, he offered the following comments with regard
to the buffer zone along the Foothills Basin Channel:
• "Foothills basin channel area will be considered a natural area...
perimeters of easement and topographic break associated with channel
design in conjunction with vegetation will define natural area
boundary."
• "City generally requires 100' minimum setback from edge of natural
area, but some board members have been arguing for requiring a larger
minimum standard buffer."
• "Staff believes the 100' minimum should be adequate here but
developer needs to have Ecological Characterization Study [of the
site]."
• "If more than 100' is provided in some locations, less than 100' may
be allowed in other locations, but developer carries burden of proof in
showing this works, and why it is necessary."
b. The buffer must satisfy the above statements from the 8/11 meeting.

10. Poudre Fire Authority:
a. See the attached Poudre Fire Authority comment sheet.
11. Park Planning, Forestry, Police, Advanced Planning, Right of Way Planning,
Transfort, and Street Oversizing:
a. I'm still waiting on comments from these departments.
12. Current Planning:
a. The bubbles on either side of the stormwater channel should either be drawn to
show the 100' setback to scale, or labeled on the ODP drawing what there setback
is.
b. Steve Comstock, the plant manager for the nearby sewage plant, has brought it to
our attention that he will be required by the EPA sometime in the future to notify
all residents down wind of his facility about the potential hazards of the chlorine
that is stored on his site. There is nothing you need to do for this other than to be
aware that some future residents might be informed there are in what is called the
chlorine "death zone" and become rather disturbed and alarmed.

and after he has had a chance to review the update to the TIS, we should set up a
meeting between Eric Bracke, Matt Delich, Vaughn Furness, Dave Peitenpol, Bob
Blanchard, Troy Jones, Sheri Wamhoff, and anyone else from staff or the
development team that would be appropriate in order to iron out this Custer Drive
intersection issue.
b. There are some lane and median concerns listed on the Traffic Operations
comment sheet. Be sure to coordinate which of these concerns must be addressed
at the ODP stage, and which can be addressed when the Timberline street
improvement project comes in.
4. Public Service:
a. There are potential power line and gas line conflicts at the corner of Timberline
and Drake that will need to be addressed at the street improvement project stage
and/or the phase "A" PDP.
b. See the attached Public Service comment sheet.
5. Streets Department:
a. Add text within the Planning Objectives that a home owners association and/or
business owners association will be responsible for snow removal on sidewalks
along Drake Road, along Timberline Road, and any bicycle and pedestrianways.
6. Transportation Planning:
a. The Traffic Impact Study (TIS) must be amended to address the pedestrian and
bicycle connections to the Poudre River trail and the Environmental Learning
Center at the north-east corner of the site.
b. It appears that pedestrians and bicycles traveling north on County Road 9 who
want to make the connection to the Poudre River trail are required to take the new
curved road out of the way to the west before connecting to a trail accessing the
Poudre River trail system. A more direct connection should be provided.
c. Any bicycle/pedestrian paths that follow the alignment of the old portions of
Drake Rd and County Road 9 must be separated from the roadway because there
will continue to be a high number of cement and gravel trucks using those
roadways.
d. Any new pedestrian/bicycle path that roughly follows the old alignment of
County Road 9 should be located on the west side of the Fossil Creek Inlet Canal.
e. Detailed Transportation comments will be provided to you as soon as they are
available.
7. Engineering Department:
a. Show on the ODP the connections where the new curved section of Drake/CR9
road will attach with the remaining portion of the old Drake Road and the
remaining portion of the old CR9.
b. The old remaining portions of Drake and CR9 will need a description of what
happens to them. Maybe Drake will remain public, and CR9 becomes the
ownership of the gravel company. This may be an ODP issue, or maybe a phase 2
issue. These issues should be addressed, with Sheri Wamhoff.

Staff reviewed the Submittal of the Rigden Farms ODP, and would like to offer the
following comments:
COMMENTS:
1. Water and Sewer Utility Department:
a. See the attached Water Utilities comment sheet.
2. Stormwater Utility Department:
a. There are some modeling issues that have been submitted with more detail than is
required at the ODP stage. While the Stormwater Department likes to see this
wholeistic level of detail, it is not required for the ODP. You may decide to
proceed with this level of detail, but keep in mind that it may require several
rounds of design revisions. If you cut back the level of stormwater calculation
detail to the minimum that is required, you could quickly satisfy the requirements
without holding up the project. Contact Basil Hamdan if you have any questions
on this.
b. The Stormwater Department will be meeting early next week directly with JR
Engineering, and will leave their comments with them. They will then forward
me a copy of the comment sheet.
c. The Stormwater comment sheet will be provided to you as soon as I receive a
copy.
3. Traffic Operations:
a. Eric Bracke, the Traffic Operations Engineer, is not inclined to approve the Custer
Drive traffic signal location at 1000' given the current calculation provided in the
Traffic Impact Study. He is leaning toward not wanting any new traffic lights
between Drake and Vermont on Timberline. The design of this intersection will
depend on the how well any new revisions to the TIS address his concerns. Eric
has already contacted Matt Delich to coordinate his concerns. Eric will be on
vacation from March 6 through March 14. As soon as we can after Eric returns
