from the staff at the public hearing that the staff report should be
modified. The report indicates that the applicant had maintained a
a 50 foot buffer as required by the Land Use Code Division 3.4.1
(E). However, the testimony and the exhibits indicate that the
applicant will be constructing two water quality ponds and a
temporary turn around at Rigden Parkway.
Findings of Fact. Conclusion and Decision
The Hearing Officer finds that the activity within the buffer zone is
for an accepted limited purpose as allowed in the code. The
Hearing Officer approves the limited activity within the buffer zone
subject to full compliance with the provisions of the LUC 3.4.1 (E)
(2) (b). The applicant shall submit plans, to the appropriate city
officials, that fulfill these standards for review and approval prior to
undertaking any development activity within the buffer zone. In the
event the staff and the applicant do not agree upon the measures
to comply with the referenced standard the matter shall be referred
to the Hearing Officer for determination.
The Hearing Officer's decision is hereby amended and the above
stated condition is added to the decision as condition of approval

Background
1. On September 3, 1999 the Hearing Officer submitted his
findings, conclusions and decision in the above referenced case.
Subsequently the Hearing Officer was informed that his decision
was unclear. Staff informed the Hearing Officer that testimony
presented by the planning staff which modified the staff report was
appeared inconsistent with the decision.
