Section 3.2.1(N)(2) of the Land Use Code also states that "the decision maker shall take into account
whether the alternative preserves and incorporates existing vegetation in excess of minimum
standards, protects natural areas and features, maximizes tree canopy cover, enhances neighborhood
continuity and connectivity, fosters non -vehicular access, or demonstrates innovative design and use
of plant materials and other landscape elements."
In reviewing this Alternative Compliance, please note the proposed plan:
1. preserves and incorporates existing vegetation in excess of minimum standards - not
applicable, no existing trees in these areas to preserve.
2. protects natural areas and features - roads and street trees have been planned to protect the
Foothills Channel with an average 100' wide, 50' minimum buffer area;
3. maximizes tree canopy cover - by averaging street trees we will be able to maximize
canopy;
4. fosters non -vehicular access - streets have been widened to accommodate bicycle lanes
adjacent to pavement;
5. demonstrates innovative design and use of plant materials and other landscape elements -
by clustering the trees canopy closer along side streets, we are able to plant one tree per lot
along the street frontages. Trees are evenly spaced along both streetscape's.
Thank you for reviewing this Alternative Compliance to modify the Land Use Code to average the
street tree at a 40' average spacing.

Request for Alternative Compliance for Land Use Code 3.2.1.D.2
Landscaping and Tree Protection, Street Trees
Dear Troy:
This letter is to'request Alternative Compliance for the above mentioned project. The Land Use Code
3.2.1.D.2 — Street Trees, requires that whenever a sidewalk is separated by a parkway, the canopy
street trees shall be planted at 30'-40' spacing (intervals) in the center of all such parkways.
This Alternative Compliance is a result of conflicting utilities in areas of smaller lots. A portion of
the Rigden Farm PDP has 50' wide lots. In planning this project, we have found that it is not
possible to plant street trees at a 40' or less spacing because of the conflict with utilities and
driveways.
Rigden Farm proposes to average the tree spacing along the side streets and street frontages (houses
fronting) to accomplish a 40' spacing average. The average will begin and end mid -block of the side
streets. It will average the street trees along the street frontage and the trees along the two side streets
to achieve a uniform spacing of trees.
In reviewing an Alternative Compliance Plan, according to Section 3.2.1(N)(2) of the Land Use
Code, "the decision maker must first find that the proposed alternative plan accomplishes the
purposes of this Section equally well or better than a plan which complies with the standards of this
Section."
The "purpose" of this section, as described in 3.2.1 (B) of this Section is to "ensure significant
canopy shading to reduce glare and heat build-up, contribute to visual quality and continuity within
and between developments, provide screening and mitigation of potential conflicts between activity
areas and site elements, enhance outdoor spaces, reduce erosion and stormwater runoff, and mitigate
air pollution."
These proposed alternatives will better accomplish the purposes of the this Section of the Land Use
Code by:
1. contributing to an overall visual quality and continuity within this development;
2. enhancing the outdoor streetscape;
