Dear Stan:
It has come, to my attention that at a meeting with City Staff on Friday, July 30, 1999,
that segment of the Foothills Channel Trail that is on the First Assembly of God property
(Timberline Church) is to be "benched" into the side of the onsite detention pond. This
trail design presents problems for trail width, trail easement width, shoulder width,
erosion control and safety.
The Foothills Channel Trail is an important pedestrian and bicycle connection among
neighborhoods. This trail will link the Stewart Case Neighborhood Park with the
Environmental Learning Center and the Poudre River Trail. It is critical that the trail be
designed in the best manner possible to fulfill its important function.
Please be aware that the Land Development Guidance System requires that the following
three criteria be answered in the affirmative if the First Assembly of God (Timberline
Church) is to be approved by the Planning and Zoning Board:
All Development Criterion A-2.1:
"Can the additional traffic (vehicular, pedestrian and bicycle traffic) generated by
the land uses within the project be incorporated into the neighborhood and
community transportation network without creating safety problems? Can
impacts from additional vehicular traffic meet city traffic flow delay policies?
Can pedestrian and bicycle needs to be addressed so that opportunities for these
travel modes are integrated into the overall city pedestrian and bicycle system?"
All Development Criterion A-2.3:
"Do the physical elements of the site plan adapt well to the physical
characteristics of the site and minimize the disturbance of topography, water
bodies, streams, wetlands, wildlife habitats, vegetation and other natural
features?"

Issues that seem to be resolved (let me know if they are not)
-), The city's park planning department (Janet Meisel -Burns) has committed to obtaining the off -
site easement through Pinecone Apartments. The timing of the acquisition of this easement is
still a bit uncertain, but given the fact that HUD may be involved it may take more than a year
(or even longer).
Rigden Farm PDP will be considered to be satisfying the LUC Section 3.6.4(A) that requires
that "all development plans shall adequately provide pedestrian facilities necessary to
maintain the adopted transportation Level of Service standards contained in part II of the FC
Multimodal Transportation LOS Manual" if and only if:
a) The money to build the trail is escrowed,
.b) The trail has been fully designed,
c) The development agreement clearly specifies that once the easement has been
obtained by Park Planning for the Pinecone site, construction of the bridge and the
Pinecone portion of the trail will commence within 90 days,
d) The development agreement clearly specifies that no more than 25% of the Building
Permits can be granted for Rigden Farm 1" Filing until the trail construction is
completed across the church site.
Neither the Church or Rigden Farm will be allowed to go to hearing until the design of the
trail is finalized.
As soon as there is a design established for the trail, Janet Meisel -Bums can proceed with the
easement negotiation with Pinecone Apartments.
Issues that still need to be resolved
—> Rigden Farm is required to make the connection to Stewart Case Park (LUC 3.6.4(A)), but the
Church is being required to "provide appropriate pedestrian and bicycle links to the
neighborhood and community, as well as, through the development being proposed" (LDGS
A-2.6). Does the fact that there are different requirements that regulate each project imply a
different level of contribution that each project should be required to pay? If a different level
of contribution is required, what is a fair ratio with which to share the costs?
--> It is my understanding that the city's contribution (Park Planning money) to the trail will be to
come in at a later date and widen the trail from 5 feet to the ultamate 10 feet width, but the
cost of the following items are split how?:
a) The design and construction of the trail across Pinecone Apartments (Does the
church have to help with this cost?)
b) The design and construction of the bridge across the Foothills Channel (When and
how does the city chip in for their portion of this bridge cost, and how much of this
cost should the church be required to pay?)
—� The main purpose of the meeting is to come up with a design for the trail on the church site
that both the Rigden folks and the Church folks agree to. It sounds like once the design is
established, then whichever project builds the trial on the Church site will be elegible for a
repay from the other development at the time the last one to develop pulls a building permit.
Which city department would manage the escrow?
PLEASE COMMENT ON THIS LIST!!! PLEASE FORWARD ANY RESPONCES TO ALL THE
RECIPIENTS OF THIS ORIGINAL MESSAGE! Hopefully by Monday morning we will all be on the
same sheet of music on all these issues.
To Be Resolved
1) We must come up with a design for the trail and bridge on the church site and
the Pinecone Apartments site.
2) Rigden Farm is required to make the connection to Stewart Case Park which links the
development to Fort Collins High School (LUC 3.6.4(A)), but the Church is being
required to "provide appropriate pedestrian and bicycle links to the neighborhood and
community, as well as, through the development being proposed" (LDGS A-2.6). The
question then comes up, "how much of the cost of the trail and bridge should the
church be responsible to pay. Paul Eckman feels that legal precedents have been
established in this situation that suggest that the degree of the church's participation
should be "roughly proportional" to the degree of impact of the church's
development. We must come to an agreement on what this proportion should be.
3) The city's contribution (Park Planning money) to the trail will be to come in at a later
date and widen the trail from 5 feet to the ultimate 10 feet width, but the cost of the
following items need to be determined at this meeting:
a) The design and construction of the trail across Pinecone Apartments
(What is an accurate "rough proportion" of the impact the church
has on this portion of trail?)
b) The design and construction of the bridge across the Foothills Channel
(What is an accurate "rough proportion" of the impact the church
has on the bridge?).
4) Which city department would manage the escrow?

Purpose #1: To come up with a design for the trail and bridge on the church site and
Pinecone Apartments that all three parties (city, church, Rigden) agree to.
Purpose #2: To determine who is going to pay for which portions of the trail and in
what proportions.
Agreed
