I did some checking around on the "not more than 90% single housing type" requirement
as specified for the LMN zone in the Land Use Code Section 4.4(D)(2)(d). I checked
with Clark Mapes from Advance Planning, and he informed me that this topic had quite a
bit of discussion and debate while the code was being written.
According to the most recent drawing of the site that I have, it looks like phase four has
approximately 57 acres and has 173 lots. This being the case, you would need three
different housing types for phase four. If you chose to have 90% of the dwelling units as
single family detached lots over 6000 square feet, then 17 dwelling units (not lots) would
need to make up the remaining 10% in the form of 2 other housing types.
You do have the right to seek a modification to this standard. A change to the code is
underway that should be adopted by council in March 1999, that would allow you to seek
a modification from the P & Z Board on one issue, without bringing the entire project
before the Board. This amendment to the code is intended to give an applicant the ability
to seek a ruling on a potentially project stopping issue prior to going through extensive or
costly engineering. The issue would be brought before the Board prior the submittal of
the phase four PDP. If the modification is granted, the PDP application must be
submitted within one year of the decision, or the modification expires.
It would only be fair to let you know, however, that the Advance Planning department
has expressed that they think even though there will be a wide variety of housing types in
the project as a whole, a parcel approaching 60 acres should not be excused from this
standard. They feel that it is specifically this type of situation for which this part of the
code was intended to regulate.
