to serve. My interpretation of this section of the code is that all
units except for the ones identified in the redlined plan have adequate
guest parking on -street. The units identified are rather distanced
from any possible on -street guest parking, so they need some sort of
proportionately distributed off-street guest spaces to accommodate
these units.
k. Please make a note on the site plan that the density is higher than the
allowed maximum density in the LMN zone because this site is part of
the Rigden Farm ON, and is consistent with the densities allowed for
this site on that ON.
Be sure and return all your redlined plans when you resubmit.

d. Section 3.2.2(K)(1)(a) specifies the number of parking spaces required
per unit based on the number of bedrooms in each unit. Based on the
units shown, you are required to have 182 parking spaces. Without
being able to count the parallel parking, you would be 26 spaces short
of meeting that requirement. If Rockford Drive can be a private
street, those parallel spaces on Rockford could partially reduce the
26 space deficit.
e. Planting note #17 must be removed. Trees cannot be eliminated if by
doing so, would result in Section 3.2.1(D)(2) Street Trees, not being
satisfied. Modifying street tree locations would be acceptable if by
doing so, the plan still satisfied the spacing requirements of
3.2.1(D)(2). Keep inmind that ornamental trees can be located within
15 feet of a street light while canopy trees require 40 feet separation
from the street light.
f. Take off the work "potentia►" from the plant ►ist title. Provide the
quantity information for each plant type. As per section 3.2.1(D)(3),
you cannot have more than 15% of your trees be any one species.
g. Section 3.5.2(D)(2) of the LUC requires 15 foot building setbacks
along Des Moines if it becomes a public street. Several of the
buildings along Des Moines are closer to this right-of-way than 15
feet.
h. The visual terminus of Rockford Drive ends with a view to a garage
door. Please provide a landscape screen in the yard area (circled on
redlined site plan) to block this view of the garage from the
southbound Rockford Drive viewshed.
i. Section 3.6.2(K)(1) states, "private streets shall not be permitted if
(by plan or circumstance) such streets would, in the judgment of the
City Engineer, attract "through traffic" in such volumes as to render
such streets necessary as connections between developments,
neighborhoods or other origins and destinations outside of the
development plan." The Engineering comments have stated that the
City Engineer has judged Des Moines to attract "through traffic," and
therefore it needs to be public.
j. There are a few buildings on the site plan that are somewhat
distanced from any possibility of on -street or off-street guest
parking areas. Please see the locations depicted on the redlined site
plan. Section 3.2.2(0)(3)(c) requires that off-street guest parking
spaces be distributed proportionately to the units they are intended

17. Poudre Fire Authority:
a. Please see the attached comment sheet from PFA.
18. Current Planning:
a. Section 2.2.11 of the Land Use Code requires that an applicant submit
revisions based on this letter within 90 days or the project application
becomes null and void. Your response to the City's concerns is due by June
13, 2000. A 30 day extension to this deadline is available. All requests for
an extension should be directed to the Current Planning Director. If
remaining issues are those that do not require plan revisions, a status report
verifying continuing efforts toward resolving the issues is required within
the same timeline.
b. The definition of "street" in article 5 of the LUC may or may not be
worded so the definition includes a pedestrian path in a public access
easement as being a "street." Because of this, there is disagreement
among staff that the path you. provide along the drainage channel
would in fact be able to be counted as a street sidewalk from which
the 200 feet can be measured to satisfy 3.5.2(C)(1). Because of the
complexity of issue, We will be having staff, discussions in the next
few days to try to resolve the issue internally. I will let you know by
Tuesday, March 21 what the decision is.
c. Engineering has stated that Des Moines Drive (and possibly Rockford
Drive too) must be a public street. This being the case, you will not be
allowed to count the on -street parking spaces of Des Moines toward
your parking requirements unless you can request and are granted a
modification to the LUC to allow the on street parking to count toward
the minimum parking requirement. It is not clear at this time what the
section of the code would be that you would request a modification to
in order to be allowed to count the on -street parking. This issue needs
further staff discussion. I will let you know by Tuesday, March 21
what the decision is.
6. Light & Power:
a. Light and Power strongly recommends a utility coordination meeting
given the tight site conditions.
b. Will need to coordinate meter locations.
7. Public Service (New Century Energies)
a. Please see the attached comment sheet from New Century Energies.
8. Building Inspection:
a. Please seethe attached comment sheet from the Building Inspection
Department.
9. Traffic Operations:

b. The crosswalks for the roundabout should be the only enhanced ones,
the Streets Department will not want to maintain all the crosswalks on
Des Moines and Rockford.
