This letter is to follow up on the questions you had during our telephone
conversation a few days ago.
Your question #1) Is the Stormwater Department planning on owning the
stormwater channel that goes through tract F?
Answer) No, it will need to be owned and maintained by a Home Owners
Association.
Your question #2) The LUC code requirement in section 3.5.2(c)(1) requires
every primary entrance to a dwelling unit to be no more than 200' from a "street
sidewalk." Can the major walkway spine running through the site along the
stormwater channel be used as a substitute for a "street sidewalk" from which
the 200' measurement is taken?
Answer) You will have to request a modification to section 3.5.2(C)(1) from the
Planning and Zoning Board. You are allowed to take this one issue to the board
without having to take the entire project before them for review.
Keep in mind that if you split this large block into 2 smaller blocks with, a public or
private street, you can place a "street sidewalk" in the interior of the site, thereby
satisfying the 200' requirement for all areas of your site. This would also allow
you to get utilities into the interior of your site.
