The alternative compliance section does not apply to residential parking, therefore his only option is to
comply or seek a modification. In my opinion, the modification he's requesting is to reduce the required
number of off-street parking spaces. It sounds like his argument would be that his "public street" is not
the typical public street, it's really more like a private drive that Engineering is requiring him to dedicate as
ROW. If it was a private drive, it would count as off-street. I don't see why he would be asking to modify
the title of the section.

Carl Glaser wants to find out if it would be possible to request a modification to allow on -street parking on
a public street to count toward required residential parking counts. Is seems that the only codified reason
on -street parking doesn't count is because the requrement for residential parking is within a section titled
"Parking Lots - Required Number of Spaces for Type of Use." It then becomes a question as to which
specific section of the code requires the parking to be off-steet. Is it the title of (K) that would need to be
modified, or could 3.2.2(K)(1)(a) (residential parking required space counts) be modified ? Can he even
request a modification for this?
