modifications throughout Rigden Farm. This is the largest test with a lot of the things in
the Land Use Code.
Public Input
Vaughn Furness, Jim Sell Design spoke on behalf of the applicant. He stated that one
of the problems they are having on this site is that they looked at the sites coming in
and took the gross acreage from the centerline of the road and then figured out the
Overall Development Plan. What has happened is that when they got into the PDP
process they realized that they wanted a unity throughout the whole project so they
platted the roads around part of this site and they did a lot of other roads. That shrunk
the property down so when the client was buying the property, they were buying net
acreage. The city has now required them to shrink the properties along Drake Road 12
feet because they have now added a turn lane. It is because of platting the roads that is
causing the need for this modification.
Public Input Closed
Member Carpenter moved for approval of the Modification of Standard for the
Rigden Farm Parkside West.
Member Gavaldon seconded the motion.
The motion was approved 7-0.

Project: Modification of Standard, Rigden Farm,
Parkside West, Project Development Plan,
#56-981
Project Description: Request to increase the maximum density
permitted in the LMN zoning district from 12.0
to 13.76 dwelling units per gross acre.
Recommendation: Approval
Hearing Testimony, Written Comments and Other Evidence:
There was no staff presentation.
Member Gavaldon asked if the applicant was asking to go from 43 to 48 units.
Planner Jones replied that was correct.
Member Gavaldon asked if this was from the shifting of the Overall Development Plan.
Planner Jones replied that this is Tract F on the Overall Development Plan. Tract F
specified a density range and this falls within that density range that was specified on
the ODP for Tract F, which was a minimum of 131 and maximum of 196 units. The
other piece of F, already has an approval on it that was a Type 1 review. It came in at a
density of approximately 10 dwelling units per acre. Because it came in at that density,
and because the left over piece is a lot smaller than the 10 unit per acre piece, there is
a unique situation where going more than 12 units per acre, would allow them to
continue to comply with the ODP. The one thing that they don't comply with is the
standard within the Land Use Code that says that any one phase of a PDP, cannot go
over 12 units per acre.
Member Gavaldon was concerned with the modifications that are coming in on Rigden
Farm, and was there any way of preventing more discrepancies in the future so then
everyone gets their fair share and it blalances out.
Planner Jones stated that his opinion to the answer to that question is that it is hard to
know the real answer to that question. He thought that there will be a lot of
