This letter is in response to your inquiry about the status of the Rigden Farm 9`h Filing —
Parkside Commons. This project received final approval on August 6, 2004. To date all
streets on the 4 sides of the development are constructed, the internal private drives are
constructed, and the required utilities to serve the development are in place and complete.
Buildings have been constructed on Building Envelopes E & F. Based on this, the
development satisfies the City of Fort Collins definition of "substantial completion" to
permanently vest a development right on the project in its entirety. A developer may, at
any time, apply for and be issued a building permit for any of the remaining unbuilt
structures on Building Envelopes A — D and G — K.
