2. Compliance with Article 4 and the LMN Zone District Standards:
There is no change in the development density approved under the original PDP
submittal; therefore, the plat continues to comply with the standards found under
Article Four of the Land Use Code.
There was no evidence introduced at the hearing to contradict the Staff Report;
therefore, the Hearing Officer finds that the Subdivision is in conformance with
the applicable requirements found in Article 4 of the Land Use Code.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 [B] — Lots
The proposed lots comply with the design standards in that each lot has
vehicular access to a public street, and the side lot lines are at substantially right
angles or radial to the street. The design of the adjacent platted roads is
unaffected.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat indicates that the necessary access, utility and drainage easements
necessary to serve the lots were provided on the original plat. No new
easements are needed for the proposed replat.
SUMMARY OF CONCLUSIONS
A. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan is
subject to administrative review and the requirements of the Land Use Code
(LUC).
B. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan
satisfies the development standards of the LMN zoning district.
C. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan
complies with all applicable General Development Standards, including the Plat
Standards, contained in Article 3 of the Land Use Code.

The surrounding zoning and land uses are as follows:
N: LMN; existing open space and drainage channel (Rigden Farm)
S: LMN; existing single-family and multi -family residential (Rigden Farm)
E: LMN; existing open space and single-family residential (Rigden Farm)
W: LMN; existing single-family and multi -family residential (Rigden Farm)
The properties were annexed into the City as part of the Rigden Farm
Annexation in August, 1988.
The properties were subdivided as Lots M1 and M5 of Rigden Farm, Filing Six in
October, 1999. Lot M1 was approved for a 3-plex building site and Lot M5 was
approved as a 6-plex building site.

Amendment application.
• Lot M5- replat the 29,196 square foot lot into six lots with the resulting square
footages:
-Lot 1 3,469 square feet
-Lot 2 3,966 square feet
-Lot 3 4,496 square feet.

-Lot 5 5,495 square feet
-Lot 6 6,805 square feet
The lot was originally approved for one 6-plex building. The replat will provide a
separate lot for each single family dwelling. Approval to replace the 6-plex with
six detached single family houses is being reviewed under a separate Minor
Amendment process.

The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 5:15 on October 13, 2005 in Conference Rooms C and D at
281 N. College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning

PROJECT DESCRIPTION:
The Applicant has submitted a request to replat Lots M1 & M5 of the Rigden Farm,
Filing Six Subdivision into nine (9) lots with the following configuration:
• Lot Ml- replat the 12,470 square foot lot into three lots: Lot 1 of 4,559 square
feet, Lot 2 of 3,818 square feet, and Lot, 3 with 4,093 square feet. The lot was
originally approved for one 3-plex building. The replat will provide a separate lot
