Compliance with Article 4 and the LMN Zone District Standards: There is no change in the development density approved under the original PDP submittal; therefore, the plat continues to comply with the standards found under Article Four of the Land Use Code. There was no evidence introduced at the hearing to contradict the Staff Report; therefore, the Hearing Officer finds that the Subdivision is in conformance with the applicable requirements found in Article 4 of the Land Use Code. 3. Compliance with Article 3 of the Land Use Code — General Development Standards A. Section 3.3.1 [B] — Lots The proposed lots comply with the design standards in that each lot has vehicular access to a public street, and the side lot lines are at substantially right angles or radial to the street. The design of the adjacent platted roads is unaffected. B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications The plat indicates that the necessary access, utility and drainage easements necessary to serve the lots were provided on the original plat. No new easements are needed for the proposed replat. SUMMARY OF CONCLUSIONS A. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan satisfies the development standards of the LMN zoning district. C. The Rigden Farm Filing Six, Replat of Lots M1 & M5 Project Development Plan complies with all applicable General Development Standards, including the Plat Standards, contained in Article 3 of the Land Use Code. Site Context meeting: FACTS AND FINDINGS The surrounding zoning and land uses are as follows: N: LMN; existing open space and drainage channel (Rigden Farm) S: LMN; existing single-family and multi -family residential (Rigden Farm) E: LMN; existing open space and single-family residential (Rigden Farm) W: LMN; existing single-family and multi -family residential (Rigden Farm) The properties were annexed into the City as part of the Rigden Farm Annexation in August, 1988. The properties were subdivided as Lots M1 and M5 of Rigden Farm, Filing Six in October, 1999. Lot M1 was approved for a 3-plex building site and Lot M5 was approved as a 6-plex building site. The replat will provide a separate lot for each single family dwelling. Approval to replace the 6-plex with six detached single family houses is being reviewed under a separate Minor Amendment process.
