Specifically, you have asked for clarification on the time frame for recordation of a project development plan, preliminary plat, final plan and plat which is outlined in Land Use Code (LUC) Section 2.2.11. Specifically, you have asked the time frame in which a plat must be filed. Section 2.2.11(C) Project Development Plan and Preliminary Plat outlines that an applicant within three (3) years following the approval of a project development plan, must obtain the Director's approval of a final plan for all or part of the project development plan. The Director may grant one (1) extension of the foregoing three-year requirement to not exceed six (6) months in length. LUC Section 2.2.11(D) Final Plan and Plat and Other Site Specific Development Plans refers to an applicant having a maximum of three (3) years following the approval of a final plan or other site specific development plan, to undertake, install and complete all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire hydrants and storm drainage) in accordance with city codes, rules and regulations. The Land Use Code calls out this period of time as "term of the vested property right." And per LUC Section 2.2.11(D)(4) on written request by the applicant, the Director may grant extensions for two (2) successive periods of six (6) months. Any additional six-month extensions shall be approved, if at all, only by the Planning and Zoning Board per LUC Section 2.2.11(D)(4).
