College Avenue Fort Collins, Colorado VIA HAND DELIVERY RE: Letter of Intent in Connection with Off -Site Easement for Linden Park Dear Mr. Fuchs: The purpose of this letter is to confirm with the City of Fort Collins the intention of the undersigned owners to grant an easement over and across our property, which is legally described on Exhibit A attached hereto and incorporated herein by reference, to TM One, Inc., the developer of the Linden Park Subdivision. The easement is briefly summarized as follows: A temporary construction easement to TM One, Inc. for the purpose of grading and filling to create a slope on our property in three areas, each approximately twenty feet (20') wide, along the southern boundary of our property adjacent to the Linden Park Subdivision in accordance with the final engineered utility plans approved by the City of Fort Collins for the final plat of Linden Park, and any modifications thereto approved by the City. The area of the easement is more particularly described on Exhibits B-1, B-2 and B-3 attached hereto and incorporated herein. In its use of the easement, TM One shall use its best efforts to protect our grazing animals and those of our tenants and lessees, and shall not block, dam or obstruct, in any manner, irrigation water flows on our property. TM One further agrees to replace and restore, at its sole cost and expense and to our satisfaction, any of our property or improvements located thereon which have been disturbed or damaged by its construction operations to the condition of such area and/or improvements before the performance of the construction. TM One further agrees to install and maintain a construction fence at all times that construction is in progress. Such construction fence shall clearly and visibly delineate the boundaries of the easement.
