College Avenue Fort Collins, Colorado Re: Letter of Intent in Connection with Off -Site Easement for Linden Park Dear Mr. Fuchs: The purpose of this letter is to confirm with the City of Fort Collins upon final negotiation and execution of an Easement Agreement with TM One, LLC, the undersigned owner intends to grant a temporary construction easement over and across our property, which is legally described on Exhibit A attached hereto and incorporated by reference, to TM One, LLC, the developer of the Linden Park Subdivision. The temporary construction easement is briefly summarized as follows: A temporary construction easement to TM One, LLC for the purpose of grading and filling to create a slope on our property in an area approximately twenty feet (20') wide along the northern boundary of our property adjacent to the Linden Park Subdivision in accordance with the final engineered utility plans approved by the City of Fort Collins for the final plat of Linden Park, and any modifications thereto approved by the City. The area of the easement is more particularly described on Exhibit B attached hereto and incorporated herein.
