Subject: Johnson -Harmony Annexation (City File #4-99)
Les Kaplan submitted the Johnson -Harmony Annexation on March 17, 1999, for
annexation and zoning of approximately 63.265 acres located south of East Harmony
Road and east of Cambridge Avenue. The request went to the Fort Collins City Council
on July 6, 1999, for first reading, and was scheduled for a July 20, 1999, second
reading.
Over the past few months, staff has been assisting Les Kaplan and some surrounding
property owners with an Overall Development Plan of the area to cooperatively deal with
access, storm drainage, and street construction. However, on July 12, 1999, Les Kaplan
submitted a request to postpone second reading of his annexation and zoning to
September 21, 1999. The Growth Management Lead Team met on July 13, 1999, and
discussed the postponement of the Johnson -Harmony Annexation.
First, the Johnson -Harmony Annexation establishes the contiguity needed for the Willow
Brook First and Second Annexations under review at this time. The Willow Brook
Annexations were scheduled to come to the Fort Collins City Council on August 17,
1999, for first reading, and September 7, 1999, for second reading.
Second, in lieu of a formal withdraw of the Johnson -Harmony Annexation, the request to
postpone the second reading is favored by staff to allow Les Kaplan sufficient time to
finalize his cooperative efforts with the surrounding landowners. However, since the
Willow Brook Annexations are scheduled for second reading on September 7, 1999,
staff would support the postponement of Johnson -Harmony Annexation to September 7,
1999. This compromise would allow a coordinated second reading of all annexations.
Based on the applicant's request, there is no risk in delaying second reading of the
Johnson -Harmony Annexation on September 7, 1999.
In summary, the Johnson -Harmony annexation and zoning request was scheduled to go
to the Fort Collins City Council on July 20, 1999, for second reading. However, the
applicant's request dated July 12, 1999, to postpone the second reading and staffs
review of the applicant's request effectively re-establishes the second reading of the
ordinances to annex and zone as September 7, 1999.

Dear Ron and Wanda:
As both the owner of the 41-acre Johnson Property contiguous to the City limits
and the purchaser of the 20-acre .LeFever Property, together comprising the
Johnson -Harmony Annexation, I am herein requesting a postponement of the:
Second. Reading for this annexation from the scheduled Ju1y20, 1999 meeting of
the City Council until the September 21,1999 meeting.
This annexation sets the stage for additional annexations to the south and east,
and in so doing creates an excellent opportunity for a coordinated approach to
land planning and engineering. Before I am comfortable in completing this
annexation, I need additional time to be assured that the prerequisite spirit of
cooperation with the prospective users of these adjoining properties exists. 11
strongly believe that the opportunity for a comprehensive planning approach be
preserved.

BACKGROUND:
The Johnson -Harmony Annexation #4-99 is approximately 63.265 acres in size and is located south
of East Harmony Road and east of Cambridge Avenue. The site is currently zoned FA1 — Farming
in Larimer County.
An Annexation Impact Report for this was forwarded to the Board of County Commissioners on
May 10, 1999.
This is a voluntary annexation, located within the Urban Growth Area (UGA) of the City of Fort"
Collins. The City may annex property, located w*thin e UC�_A provided that the property has 1/6�
contiguity with the existing City limits4 The Johnson -Harmony Annexation complies with this
standard since the property hQ33 206.E '- e� eat oPits tal bound�y of approximately 9,157.35 feet
contiguous to the existing City limits. This meets the minimum 1,526.22 feet required to achieve
1/6 contiguity.
Contiguity to existing City limits is gained from the following common boundaries: Ricketts First
Annexation (September 1993), Ricketts Second Annexation (September 1993), and Harmony Farm
Annexation (July 1994) to the west; the Harmony Annexation Number 4 (November 1977) to the
north; and, the Mary Smith Annexation (January 1995) to the east. Further, the annexation is
consistent with the Harmony Corridor Plan, which requires certain property to be annexed prior to
development.

Zoning and Analysis:

The property is currently zoned'FA&1,FarmingDistrict,, n Larimer County. The requested zoning for
this annexation is the Harmony Corridor District (HC). There are numerous uses permitted in this
District, subject to administrative review or review by the Planning and Zoning Board. The City's
adopted Structure Plan, a part of City Plan, suggests that Harmony Corridor District (HC) zoning is
appropriate for this location. Upon annexation an enclave of four lots entirely contained within the
boundaries of Fort Collins will result. Colorado Revised Statutes (CRS) 31-12-106 dictates the
procedure required to annex unincorporated enclave areas. In addition, CRS requires an enclave to
be annexed through ordinance within a period of not less than three years.
PLANNING AND ZONING BOARD RECOMMENDATION:
On May 6, 1999, the Planning and Zoning Board, by a vote of 5 - 1, recommended that the Council
approve the request for annexation and approve the zoning of Harmony Corridor District (HQ.

EXECUTIVE SUMMARY:
A. Postponement of Second Reading of Ordinance No. 109, 1999, Annexing Property Known
as the Johnson- Harmony Annexation to the City of Fort Collins.
B. Postponement of Second Reading of Ordinance No. 110, 1999, Amending the Zoning Map
of the City of Fort Collins and Classifying for Zoning Purposes the Property Included in the
Johnson -Harmony Annexation.
The applicant, Les Kaplan has requested postponement of the Second Reading of this annexation and
zoning to September 21 (see attached letter); however, staff is recommending postponement to
September 7 (see.attached memo), which coincides with the second reading of the Willow Brook
annexations and zonings. The Willow Brook Annexations are dependent on the Johnson -Harmony
Annexation to establish contiguity. Adoption ofthe Consent Agenda will postpone Second Reading
of Ordinance Nos. 109 and 110, 1999 to the meeting of September 7, 1999.
