Fuchs, City Planner A07 ` Through: John Fischbach, City Manager Subject: Johnson -Harmony Annexation (City File #4-99) vices Within the past few days Staff have fielded a number of calls from concerned citizens pertaining to the future potential closure of Cinquefoil Lane onto Harmony Road. During the initial review and routing of this annexation, the surrounding property owners were notified via mail and the property was posted. Staff did not receive any concerns during this posting period. On March 17, 1999, Les Kaplan submitted an application for annexation and zoning of approximately 63.265 acres of privately owned property located south of East Harmony Road and east of Cambridge Avenue. The property is undeveloped and is owned by Glen and Jean Johnson of Fort Collins and Donald and Dorothy LeFever of Fort Collins. The Planning and Zoning Board on May 6, 1999, recommended approval by a vote of 5- 1 to forward the Johnson -Harmony Annexation. to City Council for their approval. However, in a separate agenda item, Master Street Plan revisions were also discussed at this public hearing. The Master Street Plan revisions will ultimately impact the future development of this annexation and the surrounding area. Specifically, a question was directed to Staff if access from Cinquefoil Lane onto Harmony Road would be closed. Eric Bracke, Traffic Engineer with Traffic Operations, initial response to this question. was that Cinquefoil Lane would likely be closed at the time of redevelopment due to its proximity of the hill as it approaches County Road 7. However, upon further review, it is believed that access from Cinquefoil Lane may work safely as the originally proposed limited movement. The developer will be required to construct the access to the appropriate geometrics in conformance with the State Highway Access Code. To further clarify, Staff is unable to review access points onto Harmony Road as they may relate to this annexation. To date, the City has not received an application for the future development of the land contained within the Johnson -Harmony Annexation. Upon the City receiving an application, this development proposal will be subject to and reviewed in accordance to the requirements set forth in the City's Land Use Code (LUC) and street improvements and access concerns will be addressed by the required Traffic Impact Analysis. In summary, the access and future development of this parcel is not directly related to this annexation, and the Cinquefoil access to Harmony Road will be reviewed as a part of the Project Development Plan in the future to assure conformance to Code Standards. 281 North Colle-e Avenue • PO. At that meeting, the Board recommended approval of the annexation and approval of Harmony Corridor District (HC) zoning by a 5-1 vote. ITEM .UMBER: 26 AGENDA ITEM SUMMARY DATE: May 18, 1999 FORT COLLINS CITY COUNCIL STAFF: Ron Fuchs SUBJECT: Resolution 99-56 Finding Substantial Compliance and Initiating Annexation Proceedings for the Johnson -Harmony Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: This is a request for a 100% voluntary annexation. The property being considered for annexation is approximately 63.265 acres in size and is located south of East Harmony Road and east of Cambridge Avenue. The existing uses of the properties are agricultural in Larimer County. The proposed zoning for this annexation is Harmony Corridor District (HC). The proposed Resolution accepts the annexation petition, finds that the petition and accompanying map are in substantial compliance with the Municipal Annexation Act, and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on July 6,1999. Not less than thirty days prior published notice is required by State law. BACKGROUND: The property is located within the Fort Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property gains its 1 /6 contiguity from the common boundary with the Ricketts First Annexation (September 1993), Ricketts Second Annexation (September 1993), and Harmony Farm Annexation (July 1994) to the west; the Harmony Annexation Number 4 (November 1977) to the north; and, the Mary Smith Annexation (January 1995) to the east. Further, the annexation is consistent with the Harmony Corridor Plan, which requires certain property to be annexed prior to development.
