Statement of Principles & Policies and consistency with the City Structure Plan
This Statement is part of a Petition for Annexation for a piece of land known as the
"Harmony Technology Center" into the City of Fort Collins. The plan that accompanies
this petition shows the piece of land in its entirety, as well as adjacent landowners and the
land's contiguity to the existing boundary of the City of Fort Collins.
The land, which is the subject of this petition, contains 63.26 acres more or less. It is
located on the south side of Harmony Road, west of the I-25 Interchange in an area
designated for commercial development within the I-25 corridor as depicted on the City
Structure Plan of June, 1996. The property adjacent to the subject land which is within
the limits of the City of Ft. Collins is zoned Harmony Corridor (HQ. In the spirit of the
Fort Collins City Plan & Principles and Policies the petitioners request that upon
annexation the subject land be given the HC zoning designation.
It is desirable for the City of Ft. Collins to annex this property because its inclusion
within City Limits will contribute to the natural and well -ordered development of the
City. The subject land is located within the existing Harmony Corridor and the
petitioner's future plans call for the design and construction of a multi -use commercial,
residential, and open space district. This meshes well with the City's vision for this
particular "edge" of the City since its location and proposed use will provide for the
economic delivery of urban level public services and facilities. The petitioner's planned
future for this land is consistent with the purpose of the City Structure Plan in the
following ways:
• It is within the Urban Growth Boundary
• Planned development is close to urban transportation systems
• The City of Fort Collins is currently supplying water to the land
• Sanitary Sewer service will be provided by the South Ft. Collins Sanitation
District

PETITION FOR ANNEXATION
The undersigned hereby petitions the Council of the City of Fort Collins, Colorado, for
the annexation of an area, to be referred to as the Harmony Technology Center
Annexation to the City of Fort Collins. Said area, consisting of approximately 63.26
acres, is more particularly described on Attachment "A", attached hereto.
The petitioners allege:
1. That it is desirable and necessary that such area be annexed to the City of Fort
Collins.
2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S., exist or
have been met.
3. That not less than one -sixth of the perimeter of the area proposed to be
annexed is contiguous with the boundaries of the City of Fort Collins.
4. That a community of interest exists between the area proposed to be annexed
and the City of Fort Collins.
5. That the area to be annexed is urban or will be urbanized in the near future.
6. That the area proposed to be annexed is integrated with or capable of being
integrated with the City of Fort Collins.
7. That the petitioners herein comprise more than fifty percent (50%) of the
landowners in the area and own more than fifty percent (50%) of the area to
be annexed, excluding public streets, alleys and lands owned by the City of
Fort Collins.
8. That the City of Fort Collins shall not be required to assume any obligation
respecting the construction of water mains, sewer lines, gas mains, electric
service lines, streets or any other services or utilities in connection with the
property proposed to be annexed except as may be provided by the ordinances
of the City of Fort Collins.
9. The petitioner hereby reserves the right to withdraw this Petition for
Annexation at any time prior to the second reading of this Petition for
Annexation by the City Council.
WHEREFORE, said petitioner requests that the Council of the City of Fort Collins
approve the annexation of the area described on Attachment "A". Furthermore, the
Petitioners request that said area be placed in the HC Zone District pursuant to the Land
Use Code of the City of Fort Collins.

2. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
3. On May 18, 1999, the City Council will consider a resolution determining that the
proposed annexation process for this property by the established date, time, and
place when a public hearing will be held regarding the readings of the Ordinances
annexing and zoning the area. Public hearing and first reading of the Ordinances
annexing and zoning the property will be considered by the City Council July 6,
1999.
4. The requested Harmony Corridor District (HC) is in conformance with the policies of
City Plan and is consistent with the Structure Plan.
5. The property is located within and will be subject to the Harmony Corridor Plan.
RECOMMENDATION:
Staff recommends that the Planning and Zoning Board forward a recommendation to the
City Council to approve the Johnson -Harmony Annexation with a zoning of Harmony
Corridor District (HC).

contiguity. This contiguity occurs through a common boundary with the Ricketts First
Annexation (September 1993), Ricketts Second Annexation (September 1993), and
Harmony Farm Annexation (July 1994) to the west; the Harmony Annexation Number 4
(November 1977) to the north; and, the Mary Smith Annexation (January 1995) to the east.
Further, the annexation is consistent with the Harmony Corridor Plan, which requires
certain property to be annexed prior to development.
The surrounding zoning and land uses as follows:
N: Harmony Corridor District (HC) — existing research/development (Hewett -Packard)
S: FA-1 Farming District in Larimer County — existing agricultural
E: FA-1 Farming District in Larimer County — existing agricultural
W: Harmony Corridor District (HC) — existing residential and research/development
(Harmony Technology Park - Overall Development Plan: Celestica First Filing)
FA-1 Farming District in Larimer County — existing residential
2. Zoning and Analysis:
The property is currently zoned FA-1 Farming District in Larimer County. The requested
zoning for this annexation is the Harmony Corridor District (HC) (see attached copy of
Division 4.21 of the Land Use Code, Harmony Corridor District (HC)). There are numerous
uses permitted in this District, subject to administrative review or review by the Planning
and Zoning Board. The City's adopted Structure Plan, a part of City Plan, suggests that
Harmony Corridor District (HC) zoning is appropriate for this location. Upon annexation
an enclave of four lots entirely contained within the boundaries of Fort Collins will result.
Colorado Revised Statutes (CRS) 31-12-106 dictates the procedure required to annex
unincorporated enclave areas. In addition, CRS requires an enclave to be annexed
through ordinance within a period of not less than three years.

FINDINGS OF FACT/CONCLUSION:

RECOMMENDATION: Staff recommends approval of the annexation and recommends
that the property be placed in the Harmony Corridor District (HC).
EXECUTIVE SUMMARY: This is an annexation and zoning of approximately 63.265 acres
in size, located south of East Harmony Road and east of Cambridge Avenue. The
property is undeveloped and is in the FA-1 Farming District in Larimer County. The
recommended zoning is the Harmony Corridor District (HC). This is a 100% voluntary
annexation.
COMMENTS:
1. Background:
The Johnson -Harmony Annexation #4-99 is approximately 63.265 acres in size, located
south of East Harmony Road and east of Cambridge Avenue. The property is located
within the Fort Collins Urban Growth Area (UGA). According to policies and agreements
between the City of Fort Collins and Larimer County, contained in the
INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will annex property within the UGA when the property is eligible for
annexation according to Colorado Revised Statutes (CRS). This property is eligible for
annexation according to CRS, requiring 1/6 contiguity to the existing city limits. The
Johnson -Harmony Annexation and Zoning complies with this standard since the property
has 3,206.58 feet of its total boundary of approximately 9,157.35 feet contiguous to the
existing City limits. This meets the minimum 1,526.22 feet required to achieve 1/6
