HomeMy WebLinkAboutWATERS EDGE - MODIFICATIONS OF STANDARDS 1, 2 AND 3 - MOD150001 - SUBMITTAL DOCUMENTS - ROUND 1 -This is a request for three "stand-alone" Modifications of Standard to the City Land Use Code related to
Oil and Gas Setback buffers. Existing Oil and Gas operations require a "Buffer Yard D" as outlined in
"Residential Buffering" standards -- Land Use Code Section 3.8.26(C)(4). A link to the buffer standards is

This is not a full site plan review of the proposed project, but rather three "stand-alone" modification
requests. A complete development plan review (site plan, landscape plan, utility plans, traffic study,
etc.) would happen after the review and Planning and Zoning Board Public Hearing for the three
proposed Modifications. Should these three Modifications described above be approved, all of the
development plans must be submitted for review within one year following the approval of the stand-
alone modifications. The development plans are also subject to review and approval by the Planning and
Zoning Board at a separate public hearing.

The Land Use Code requires a minimum "Buffer Yard D" setback of 350 feet from the existing oil and gas
operations to any residential building proposed to be occupied. The property contains three existing
oil/gas well locations. The applicant is proposing three modifications:
Modification 1: To allow the construction of streets, sidewalks, and public right of way within the 350
foot Buffer Yard D area surrounding the three oil wells located on the property.
Modification 2: To allow the construction of residential dwellings within a portion of the 350 foot Buffer
Yard D areas surrounding the three oil wells located on the property, conditioned upon the oils well
having been permanently plugged and abandoned in accordance with Colorado Oil and Gas Commission
Standards. The proposed residential dwellings would be located outside of a 150 foot radius from well
heads #2 and #3, and outside a 100 foot radius from well head #5.
Modification 3: The applicant requests a modification to the Buffer Yard D landscape requirements to
eliminate the Buffer Yard D plant material and screening requirements in the areas surrounding the
three oil wells located on the property, conditioned upon the oil wells having been permanently plugged
and abandoned in accordance with Colorado Oil and Gas Commission Standards.
