Hence, the request should only be focused on the inclusion of a parking lot in the LMN District. In regard to the required public hearing, the Planning Director has set June 3, 1999, as the earliest possible date with the Planning and Zoning Board. However, this date is subject to a revised application being submitted which addresses the above referenced items. Also, prior to formalizing the public hearing date, APO labels, fees, and a legal description will be needed in order to prepare the needed legal notices for the modification of standards request. For filing purposes, this application will be referred to as the Prospect-Lemay Rite Aid (Modification Request) City File #6-99 and all future projects on this site will need to reference this city file name and number. It is the intent of the modification review process to review the request based on code criteria and forward a recommendation to the Planning and Zoning Board. The Land Use Code stipulates that the Director has the ability to deem an application complete and/or determine what additional information is needed to adequately review a modification request. This letter is to offer some insight as to what additional information or clarification is desired to review your request. In order for staff to complete a review of the modification request and forward a recommendation to the Planning and Zoning Board, we need revisions to the narrative you submitted to include: 1) per Section 3.2.2(K)(2), based on a 13,800 square foot structure, the maximum number of parking spaces would be 55, the narrative states 66 parking spaces; 2) the last four paragraphs of Section (A) should be removed since they deal with design issues which are not pertinent to nature of this modification request; 3) Section (B) of the narrative you provided focuses on why the single-family dwelling is not appropriate for this site, but should rather address the criteria by which the Planning and Zoning Board must review a modification request. Section 2.8.2(H) of the Land Use Code states that in order for the Board to grant a modification, they must find that the proposed plan: a) is not detrimental to the public good; b) does not impair the intent and purposes of the Land Use Code; c) satisfies the criteria of either (1) (2) or (3) of Section 2.8.2(H) of the Land Use Code. It seems that your most likely avenue of justification would be Section 2.8.2(H)(1), which would require you to show how your plan addresses the purpose of the section (3.2.2(A)) equally well or better than a plan, which complies with the code. To assist the Planning and Zoning Board in delineating zone categories, please add (highlight) all zoning boundaries within the surrounding area on the site plan and/or context diagram plan. In addition, to eliminate confusion, the elevations and signage should be removed from the application.
