Martell Wyatt, Martell, Weaver & Rogers LLC 222 West Magnolia Street Fort Collins, CO 80521 Dear James: I received your letter dated June 6, 2000, on behalf of Palladian Construction Company, with the accompanying preliminary design development and survey map for Old Town North. I have started the process required to sell the land as excess property, the first step being the declaration of excess property by the Region. This involves getting signatures from the different sections of the Region, along with the Region Transportation Director. An unsigned copy of the excess land fording is attached for your information. If the land is declared as excess, I will be requesting from you deeds, descriptions and any other documents necessary to transfer the property. In our earlier conversations, I stated the land available would be all that north of the Josh Ames Ditch. The maintenance supervisor for the area does not believe the ditch continued easterly onto the Department property. The final configuration of the parcel will need to be agreed upon by the Department and your client. I will also need a check for $300.00 made out to "Colorado Department of Transportation." as an administrative fee. I will forward the documents to the Highway Commission for approval to sell the land. The Department then will begin an appraisal to determine the Fair Market Value of the land. I may be contacting you, asking that the survey company stake the parcel for viewing by the appraiser. Depending on the availability of appraisal personnel, the process may take up to four months.
