As requested by Rebecca Spears, I am writing to clarify why the property at 801 S. Shields needs to go
through the process of a minor amendment, and what generally is entailed in a minor amendment.
The Fort Collins Land Use Code specifies that when a building has historically been utilized with a specific
type of land -use ("fraternity" for your building), in order to change the use of that building to any other
permitted use besides that historical use the property must go through the process of a minor amendment to
change that use.
A minor amendment is basically an administrative change to an approved site plan. Approved site plans
typically specify the specific use and site layout of a development. We require an applicant who is
applying for a minor amendment to supply a copy of the "approved" site plan, and then a drawing depicting
the changes to that site plan. Since your building was originally built in 1959, and because there are no
plans on city file for your property, we required you to generate drawings of the existing conditions, which
will work as the "approved" plan from which you are seeking an amendment.
The Land Use Code also specifies the city's development review staff must require the property to be
brought up into compliance with the code as a condition of approval to a minor amendment. This is the
reason that we are requiring changes to the site.
If you were proposing to put another "fraternity" in the building, that would not be a change of use, and
therefore would not trigger any sort of development review. Any other use besides "fraternity" that goes
into this building will trigger the development review process.
