22. The spoils areas should be out of the floodway and clearly delineated.
23. The proposed Stage 3 mining area is getting very close to the Boxelder Creek
and this could be a problem.
24. How does storm water get from the various stages of mining to the Poudre
River? How are the areas going to drain?
25. The plans need to show how the water will be cleaned up when pumping is done
on -site. How will the water be treated?
26. The Boxelder Creek floodplain could potentially get wider. This is a "no rise"
creek. How will the storm drainage be handled?
27. Will a floodplain use permit be needed for the conveyor? Is this in Larimer
County?

28. This development proposal has to go to the Planning and Zoning Board for
review. It probably should go to the Planning & Zoning Board before it goes to
the Natural Resources Advisory Board.
This completes the staff comments at this time. Additional comments will be
forthcoming as they are received from City departments and outside reviewing
agencies.
Under the development review process and schedule there is a 90 day plan revision
submittal time -frame mandated by the City. The 90 day turnaround period begins
on the date of the comment letter prepared by the project planner in the Current
Planning Department. Upon receipt, the revisions will be routed to the appropriate City
departments and outside reviewing agencies, with their comments due to the project
planner no later than the third weekly staff review meeting (Wednesday mornings)
following receipt of the revisions. At this staff review meeting the item will be discussed
and it will be determined if the project is ready to go to the Planning and Zoning Board
for a decision. If so, will be scheduled for the nearest Board hearing date with an
opening on the agenda.
Please return all drawings red -lined by City staff with submission of your revisions. The
number of copies of revisions for each document to be resubmitted is on the attached
Revisions Routing Sheet. You may contact me at 221-6341 to schedule a meeting to
discuss these comments.
b. Maximum operation height of equipment under and near the overhead
powerline is 15 feet.
C. Access for maintenance and operation of the powerline shall be
maintained at all times.
11. Representatives of the Mapping and Drafting Department stated that they will
need to see the final subdivision plat, if there is one.
12. A copy of the comments received from Kim Kreimeyer of the Natural
Resources/Planning Departments is attached to this comment letter. Also
attached is a copy of the revised Division 3.4 Environmental, Natural Area,
Recreational and Cultural Resource Protection Standards of the LUC.
13. Mark Jackson of the Transportation Planning Department asked how do
employees (and maintenance vehicles, etc.) access the new site?
The following comments and concerns were expressed at the Staff Review meeting on
August 18th:

14. This mining proposal has to go to the Natural Resources Advisory Board for
review.
15. A State Highway Access Permit may be necessary for this mining operation.
16. How do the employees get to this new site from the existing site?

17. Show all setbacks from the Boxelder Creek.
18. An evaluation for the potential presence of the Prebles Jumping Mouse must be
done for this mining proposal.
19. Show and label all buffers to the adjacent natural areas of concern.
20. Show and label limits of development.
21. It must be determined if there are owls and hawks of significance on this site.
5. A copy of the Codes and Standards (amended 5/12/99) received from Rick Lee
of the Building Inspection Department is attached to this comment letter.
6. A copy of the comments received from Jeff Hill of the Water/Wastewater
Department is attached to this comment letter. Please contact Jeff, at 221-6681,
if you have questions about his comments.
7. Basil Hamdan of the Stormwater Utility offered the following comments:
a. Need to move the mining operation further back from the top of bank of
the Boxelder Creek in the area where the top of bank is close to the
proposed mining operations as shown on the red -lined Pre -Mining
Conditions Map.
b. Please clarify how the runoff from the mining pits will get back into the
Poudre River.

8. Mark McCallum of the Engineering Department offered the following comments:
a. One question from the Engineering Department is how do the employees
access the mine site? Will the employees continue to park at the existing
site? If the employees access this new site by vehicle then the
Engineering Department will need to know where that access will be.
b. The Preliminary Subdivision Plat is not a legal document. This project
does not have to be platted, but if it is desirable to plat this property then
the language shall be changed to meet City requirements. At that time a
professional surveyor licensed in the State of Colorado shall prepare the
subdivision plat. If it is not desirable to plat this property then it is being
suggested that the "Preliminary Subdivision Plat" not be represented as a
plat.

9. Jim Slagle of Public Service Company stated that any rerouting of PSC
facilities caused by this operation will be at the developer's expense.
10. Tom McCormick of Platte River Power Authority offered the following
comments:
a. Stockpiling of soil on the overhead double circuit 230,000-volt powerline
easement shall be prohibited, as raising the ground level will cause a
National Electrical safety Code ground clearance violation.

Staff has reviewed your documentation for the RESOURCE RECOVERY FARM, Sand
and Gravel Mine, Project Development Plan (PDP) proposal that was submitted to
the City on July 26, 1999, and would like to offer the following comments:
1. This development proposal is a Type II, Planning and Zoning Board Review
under the City's Land Use Code (LUC). The request is a Type II use based on
Section 4.11(B)(3)(c)l. Industrial Uses of the LUC, which states that Resource
extraction, processes and sales, except that such uses are not permitted in
natural area protection buffers are permitted in the RC — River Conservation
Zoning District, subject to review by the P & Z Board.
The General Development Standards as set forth in ARTICLE 3 and the Land
Use & Development Standards as set forth in Division 4.11 of ARTICLE 4 of the
LUC will apply to this request.
2. A copy of a letter received from Ravi Srivastava of the Boxelder Sanitation
District, with the District's comments and concerns about the sand and gravel
mining proposal, is attached to this comment letter.
3. A copy of a letter (with a marked -up portion of the Mining Plan Map) from Glenn
Haas, Director of the Environmental Learning Center, is attached to this
comment letter. The ELC is adjacent to the west of this property. Mr. Haas' letter
reflects the ELC's comments and concerns about the sand and gravel mining
proposal.
4. A copy of the comments received from Jenny Nuckols and Peter Barnes of the
Zoning Department is attached to this comment letter. Please contact Jenny or
