Prospect into two lots, #22-99 is approved. Dated this 7th day of October, 1999, per authority granted by Sections 1.4.9(E) and 2..1 of the Land Use Code. I-ia2 Robert E. C. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) The applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. The plat shows the existing 30 feet of Prospect Road ROW from the front of the property to the road centerline. No additional ROW is being requested. A 20 feet wide utility easement is being provided on the flag portion of the rear lot to connect utilities for the lot to the utilities along Prospect Road. A 15 feet wide utility easement is being provided adjacent to prospect road. 2) Reservation of sites for flood control, open space and other municipal uses shall be made in accordance with the requirements of this Land Use Code. This criteria is not applicable to the proposed plat of Cliff Subdivision (511 E. Prospect). FINDINGS, CONCLUSIONS AND DECISION FINDINGS AND CONCLUSIONS After reviewing the staff report and the record of the public hearing, the Hearing Officer makes the following findings and conclusions: A. The proposed plat of Cliff Subdivision contains a permitted use in the LMN — Low Density Mixed -Use Residential District. B. The proposed plat of Cliff Subdivision meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. Applicant Response: Mr. Snyder responded to questions about the appearance of the homes. City Response: None BACKGROUND This application is a request to plat the existing lot at 511 E. Prospect (on file as a meets and bounds description) for the purpose dividing one large lot into two smaller lots. The existing lot is 15,170 square feet in size. The proposed lots will be 7,420 square feet and 7,750 square feet. The lot is midblock on the south side of E. Prospect Street between Whedbee Street and Smith Street, and is in the LMN - Low Density Mixed -Use Neighborhood Zoning District. The existing home would be on one lot using the existing driveway onto Prospect Street. The second lot would be a flag lot with access on the western portion of the existing lot. A home that is being relocated would be placed to the south of the existing home. The proposed plat of Cliff Subdivision (511 E. Prospect), complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. A. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) No building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance with Section 3.3.1(B) Lots in that: 1) Each lot has direct vehicular access to a public street (Prospect Road), and the side lot lines are substantially at right angles or radial to the street lines. 2) The proposed Cliff Subdivision is surrounded by existing development. The general layout of lots, roads, driveways, utilities, drainage facilities NOTICE OF PUBLIC HEARING: Notice of public hearing was made on September 22, 1999 by mailing to property owners within 500 feet of the subject property. The public hearing was advertised in the Coloradoan on September 25, 1999. PUBLIC HEARING After reviewing the Staff Report and recommendation, a public hearing was held on the subject application at 6:00 PM on October 6, 1999. The hearing was held in Conference Rooms C and D at 281 North College, Fort Collins, Colorado. Other questions were about the appearance of the homes.
