5. Findings of Fact/Conclusion:
A. The proposed plat of Cliff Subdivision contains a permitted use in the LMN
— Low Density Mixed -Use Residential District.
B. The proposed plat of Cliff Subdivision meets the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 -
Administration.
C. The proposed plat of Cliff Subdivision meets the plat requirements located
in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
RECOMMENDATION:
Staff recommends approval of the proposed plat of Cliff Subdivision at 511 E.
Prospect Road, File #22-99.

Section 3.3.1 - Plat Standards located in Article 3 - General Development
Standards.
A. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance
with Section 3.3.1(A) General Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for
construction of any new principal building or no act which changes the
use of any building shall be permitted until the subdivision plat is filed
and recorded in the City of Fort Collins.
B. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance
with Section 3.3.1(B) Lots in that:
1) Each lot has direct vehicular access to a public street (Prospect Road),
and the side lot lines are substantially at right angles or radial to the
street lines.
2) The proposed Cliff Subdivision is surrounded by existing development.
The general layout of lots, roads, driveways, utilities, drainage facilities
and other services within the proposed development meet the
standards for such layouts and services as specified of the Land Use
Code.
C. The proposed plat of Cliff Subdivision (511 E. Prospect) is in compliance
with Section 3.3.1(C) Public Sites, Reservations and Dedications in
th at:
1) An applicant shall be required to dedicate rights -of way for public
streets, drainage easements and utility easements as needed to serve
the area being platted. The plat shows the existing 30 feet of Prospect
Road ROW from the front of the property to the road centerline. No
additional ROW is being requested. A 20 feet wide utility easement is
being provided on the flag portion of the rear lot to connect utilities for
the lot to the utilities along Prospect Road. A 15 feet wide utility
easement is being provided adjacent to prospect road.
2) Reservation of sites for flood control, open space and other municipal
uses shall be made in accordance with the requirements of this Land
Use Code. This criteria is not applicable to the proposed plat of Cliff
Subdivision (511 E. Prospect).

COMMENTS:
1. Background:
The zoning and land uses that surround the proposed Cliff Subdivision are as
follows:
N: NCL; East Prospect Road, single family housing (Circle Drive Subdivision,
L.C. Moore's Third Subdivision)
S: LMN; existing residential (M.L. Deines Subdivision)
W: LMN; existing residential (block 3 of Gray -Strecker Subdivision, Flinn's
Resubdivision)
E: LMN; existing residential (Holsinger First Subdivision)
This property was annexed into the City as part of the Southeast Consolidated
Annexation, April 1957. The records for the parcel indicate the existing lot at 511
E. Prospect was established by meets and bounds description.
2. Purpose of the Replat:
The purpose of the proposed plat of Cliff Subdivision (511 E. Prospect) is to
reconfigure the one 15,170 square foot lot into two lots 7,420 and 7,750 square
feet in area. Staff has determined that there is no detriment to the surrounding
lots by the platting of this lot into two lots.
3. Article 2 - Administration:
The proposed plat of Cliff Subdivision (511 E. Prospect), complies with the
applicable requirements of the LUC, specifically the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications, and
Section 2.4 - Project Development Plan located in Article 2 - Administration.
4. Article 3 - General Development Standards:
The proposed plat of Cliff Subdivision (511 E. Prospect), complies with the
applicable requirements of the LUC, specifically the plat requirements located in
ITEM NO.

PROJECT DESCRIPTION:
This is a request to plat the existing lot at 511 E. Prospect (on file as a meets
and bounds description) for the purpose dividing one large lot into two smaller
lots. The lot is midblock on the south side of E. Prospect Street between
Whedbee Street and Smith Street, and is in the LMN - Low Density Mixed -Use
Neighborhood Zoning District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
A. The proposed plat of Cliff Subdivision would create two lots, both of which
would contain a permitted use in the LMN — Low Density Mixed -Use
Residential District.
B. The proposed plat of Cliff Subdivision meets the procedural requirements
located in Division 2.1 - General Procedural Requirements, Division 2.2 -
Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 -
Administration.
C. The proposed plat of Cliff Subdivision meets the plat requirements located
in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
