Dear Lucia:
This is in response to your August 4, 1999 request to add "theaters" as a
permitted use in the C — Commercial zoning district.
Section 1.3.4 of the Land Use Code, Addition of Permitted Uses, allows the
Director to add uses to the list of permitted uses in a particular zone district when
certain conditions are met. In the past, it has been. interpreted that this Section
applied whenever it was determined that the requested use had never been
considered for inclusion in a specific.zoning district. However, more recent
discussions among management staff have determined that this Section should
only be applied when the requested use had never been considered for inclusion
in any part of the Land Use Code. As a result, the Code was amended last year
to indicate that the Director could only add a permitted use when:
Such use is not specifically listed as a "Permitted Use" in Article 4.
(Section 1.3.4(A)(6)
Since "entertainment facilities and theaters" are permitted uses in other zoning
districts, the request to add them as a permitted use in the C — Commercial
zoning district cannot be approved using this process.
However, in reviewing the justification for the request and accompanying
documentation, staff has determined that several compelling arguments were
presented that may warrant reconsideration of earlier decisions. Therefore, we
have decided to include consideration of this proposed change as part of the
Fall, 1999 Land Use Code amendment cycle. The current schedule includes
finalization of staff recommendations by the end of September with public
hearings at the Planning and Zoning Board in October and Council hearings in
November.
