Oak Street, Suite 200 Fort Collins, Co 80524 Staff has reviewed the submittal of the Carmike Theaters Rezone request, and offer the following comments: COMMENTS: • How does this project comply with the purpose statement of the NC in 4.19(A)? It states that the district is intended to be anchored by a supermarket or grocery store. • At a minimum, the rezoning request should include lots 2A and 2B of the Park South Commercial Plaza Minor Subdivision 2nd filing. Autozone is on lot 2A and the proposed car wash is on lot 2B. It would make no sense to leave these 2 lots zoned "C." They would be an isolated pod of the "C" zone. • Rather than expanding this theater, it may be more appropriate for Carmike Theaters to build another theater in the appropriate zoning district. • Timothy Wilder's March 11, 1998 Memo (your attachment 2) states "during the City Plan process, staff and the consultants recognized that theaters should play an important role in the function and character of community and neighborhood centers envisioned by City Plan," and should "serve as an anchor in a mix of restaurants, shops and civic uses in a walkable, lively community destination." Although this memo does not specifically talk of scale of the theaters, it does mention that the theater integrate a mix of other uses, thereby implying that a single -use mega-plex theater is not the intention. The City Plan vision wants theaters to be scaled smaller (not the mega-plexes) in order to integrate that mix of uses in CC and NC areas. • Given the compelling argument you made about the trends in the size of new theaters, in a market where mega-plex theaters are allowed to exist, the smaller theaters just cannot survive. In a market where mega-plex theaters are not allowed, the type of theater we envision will perhaps be marketable. The current zoning regulations support the vision of smaller theaters as mixed -use anchors in NC and CC zones. Your rezone request would not encourage the type of theater (an anchor of a mixed -use zone including restaurants, shops and civic uses in a walkable district) that the City Plan vision is trying to promote. • The proposal as submitted is not consistent with the Structure Plan. Bob Blanchard, the Director of Current Planning is currently reviewing your request for Structure Plan amendment. I will let you know as soon as he has made a determination on this issue, and how his decision affects staffs overall support (or non-support) of the request. • My staff report for the Planning and Zoning Board should be available for your review by September 15i. The P & Z worksession is on 9/10, and the P & Z hearing is on 9/16. The project goes to council on 10/5 and 10/19. If yo have any uestions feel free to contact me.
