lot to the west. There is a joint access and maintenance agreement for
the shared access driveway. Side lot lines are substantially at right angles
or radial to the street line.
B. Section 3.3.1 (B) (2). The new lot layout and street extension is consistent
with the Poudre River Business Park Master Plan and meets the City's
street connectivity standards to the extent feasible.
C. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications. The
plat indicates proper dedications for drainage and utility easements as
needed to serve the lot. A 57 foot -wide road right-of-way, meeting the
City's standard width, will be dedicated adjacent to the property to permit
extension of Poudre River Drive. A water quality structure will be built on
the northwest corner of the site, cleansing stormwater runoff for this
property and the adjacent lot.
DECISION
The Poudre River Business Park, Second Filing, File # 24-99, is approved by the
Hearing Officer without conditions based on the following findings:
A. The request conforms to the applicable Plat Standards of the Land Use
Code.
B. The request conforms to the standards of the CCR zone district.

The Planning and Zoning Board approved the Poudre River Business Park PUD Master
Plan on November of 1998. This property became zoned CCR at the time of a Citywide
rezoning in 1997.
NOTICE OF PUBLIC HEARING AND NEIGHBORHOOD MEETING: Testimony or
evidence established that the property was properly posted, legal notice mailed, and
notice published. There was no requirement for a neighborhood meeting.
PUBLIC HEARING: The Hearing Officer, presiding pursuant to the Fort Collins Land
Use Code (LUC), opened the hearing at approximately 5:00 p.m. on February 9, 2001 in
the conference room of the City of Fort Collins Planning Department located at 281
North College Avenue, Fort Collins, Colorado.
RECORD OF HEARING: The Hearing Officer accepted during the hearing the following
evidence: (1) Planning Department staff report: (2) application and supporting
documents submitted by the applicant and the applicant's agents; (3) documents
submitted during the hearing; (4) a sign-up sheet of persons attending the hearing and
citizens speaking in favor or against the application; and (5) a tape recording of
testimony providing during the hearing.
FINDINGS AND CONCLUSIONS
The evidence presented to the Hearing Officer established facts supporting the
following findings and conclusions:
Compatible with Surrounding Uses: The proposed development is found
compatible with the following surrounding zoning and land uses:

2. Compliance with Code Requirements:
Plat Standards: The plat has been reviewed against the criteria of the Plat Standards
under Article Three, Division Three of the Land Use Code. The request to create a
32,196 sq. ft. lot complies with the following standards:
A. Section 3.3.1 (B) (1). The new lot has 262 feet of frontage along Poudre
River Drive, a dedicated public right-of-way. Vehicular access from Poudre
River Drive will be through an access driveway shared with the adjacent

PROJECT DESCRIPTION: This is a request to create a one -lot second filing of the
Poudre River Business Park. The new lot is 32,196 sq. ft. (0.7391acres). The owner is
dedicating 11,108 sq. ft. of the abutting area to the south as right-of-way for an
extension to Poudre River Drive. The new lot would be east of the existing medical
office building located on Lot 1, First Filing addressed as 1100 Poudre River Drive. The
purpose is to construct a parking area and new medical building site on the proposed
lot. Access to Poudre River Drive for the lot will be through, a driveway shared with Lot
1, First Filing. The site is located east of Lemay Avenue, south of the Cache la Poudre
River, and north of Poudre River Drive. The parcel is zone CCR, Community
Commercial, Poudre River, which allows a medical office as a permitted use.
SUMMARY OF HEARING OFFICER'S DECISION: Approval without conditions.
BACKGROUND AND ZONE DISTRICT: The property was annexed into the City of
Fort Collins in 1983 and initially zoned E-P Planned Business, with a PUP, ccndition.
