This Statement is part of a Petition for Annexation for a piece of land known as the
"Kendall -Harmony Annexation" into the City of Fort Collins. The plan that accompanies
this petition shows the piece of land in its entirety, as well as adjacent landowners and the
land's contiguity to the existing boundary of the City of Fort Collins.
The land, which is the subject of this petition, contains 2.00 acres more or less. It is
located on the south side of Harmony Road, west of the I-25 Interchange in an area
designated for commercial development within the I-25 corridor as depicted on the City
Structure Plan of June, 1996. The property adjacent to the subject land which is within
the limits of the City of Ft. Collins is zoned Harmony Corridor (HC). In the spirit of the
Fort Collins City Plan & Principles and Policies the petitioners request that upon
annexation the subject land be given the HC zoning designation.
It is desirable for the City of Ft. Collins to annex this property because its inclusion
within City Limits will contribute to the natural and well -ordered development of the
City. The subject land is located within the existing Harmony Corridor and the
petitioner's plans are to include this parcel in an Overall Development Plan for the area
which calls for the design and construction of a multi -use commercial, residential, and
open space district. This meshes well with the City's vision for this particular "edge" of
the City since its location and proposed use will provide for the economic delivery of
urban.level public services and facilities. The petitioner's planned future for this land is
consistent with the purpose of the City Structure Plan in the following ways:
• It is within the Urban Growth Boundary
• Planned development is close to urban transportation systems
• The City of Fort Collins is currently supplying water to the land
• Sanitary Sewer service will be provided by the City of Fort Collins

PETITION FOR ANNEXATION
The undersigned hereby petitions the Council of the City of Fort Collins, Colorado, for
the annexation of an area, to be referred to as the Kendall -Harmony Annexation to the
City of Fort Collins. Said area, consisting of approximately 2.00 acres, is more
particularly described on Attachment "A", attached hereto.
The petitioners allege:
1. That it is desirable and necessary that such area be annexed to the City of Fort
Collins.
2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S., exist or
have been met.
3. That not less than one -sixth of the perimeter of the area proposed to be
annexed is contiguous with the boundaries of the City of Fort Collins.
4. That a community of interest exists between the area proposed to be annexed
. and the City of Fort Collins.
5. That the area to be annexed is urban or will be urbanized in the near future.
6. That the area proposed to be annexed is integrated with or capable of being
integrated with the City of Fort Collins.
7. That the petitioners herein comprise more than fifty percent (50%) of the
landowners in the area and own more than fifty percent (50%) of the area to
be annexed, excluding public streets, alleys and lands owned by the City of
Fort Collins.
8. That the City of Fort Collins shall not be required to assume any obligation
respecting the construction of water mains, sewer lines, gas mains, electric
service lines, streets or any other services or utilities in connection with the
property proposed to be annexed except as may be provided by the ordinances
of the City of Fort Collins.
9. The petitioner hereby reserves the right to withdraw this Petition for
Annexation at any time prior to the second reading of this Petition for
Annexation by the City Council.
Furthermore, the petitioners request that said area be placed in the HC, Harmony
Corridor Zoning District. This requested zoning is consistent with the City Structure
Plan.

PETITION FOR ANNEXATION
THE UNDERSIGNED (hereinafter referred to as the "Petitioners") hereby petition the Council
of the City of Nollins, Colorado for the annexation of an area, to be referred to as the
Annexation to the City of Fort
Collins. Said area, consisti g of approximately acres, is more
particularly described on Attachment "A", attached hereto.
The Petitioners allege:
That it is desirable and necessary that such area be annexed to the City of Fort Collins

Further, as an express condition of annexation, Petitioners consent to the inclusion into the
Municipal Subdistrict, Northern Colorado Water Conservancy District (the "Subdistrict") pursuant to
§37-45-136(3.6) C.R.S., Petitioners acknowledge that, upon inclusion into the Subdistrict, Petitioners'
property will be subject to the same mill levies and special assessments as are levied or will be levied on
other similarly situated property in the Subdistrict at the time of inclusion of Petitioners' lands.
Petitioners agree to waive any right to an election which may exist pursuant to Article X, §20 of the
Colorado Constitution before the Subdistrict can impose such mill levies and special assessments as it
has the authority to impose. Petitioners also agree to waive, upon inclusion, any right which may exist
to a refund pursuant to Article X, §20 of the Colorado Constitution.
WHEREFORE, said Petitioners request that the Council of the City of Fort Collins approve the
annexation of the area de cribed on Attachment "A". Furthermore, the Petitioners request that said area
be placed in the — C Zone District pursuant to the Land Use Code of the City of Fort
Collins.

annexing and zoning the property will be considered by the City Council June 6,
2000.
4. The requested Harmony Corridor District (HC) is in conformance with the policies of
City Plan and is consistent with the Structure Plan.
5. The property is located within and will be subject to the Harmony Corridor Plan.
RECOMMENDATION:
Staff recommends that the Planning and Zoning Board forward a recommendation to the
City Council to approve the Kendall -Harmony Annexation with a zoning of Harmony
Corridor District (HC).

Johnson -Harmony Annexation (September 1999) to the east and south. Further, the
annexation is consistent with the Harmony Corridor Plan, which requires certain property
to be annexed prior to development.
The surrounding zoning and land uses as follows:

2. Zoning and Analysis:
The property is currently zoned FA-1 Farming District in Larimer County. The requested
zoning for this annexation is the Harmony Corridor District (HC) (see Division 4.21 of the
Land Use Code, Harmony Corridor District (HC)). There are numerous uses permitted in
this District, subject to administrative review or review by the Planning and Zoning Board. .
The City's adopted Structure Plan, a part of City Plan, suggests that Harmony Corridor
District (HC) zoning is appropriate for this location.
3. City Council Hearings:
City Council hearings on this proposed annexation and zoning will be held on the following

FINDINGS OF FACT/CONCLUSION:
The annexation of this area is consistent with the policies and agreements between
Larimer County and the City of Fort Collins as contained in the Intergovernmental
Agreement for the Fort Collins Urban Growth Area.
2. The area meets all criteria included in Colorado Revised Statutes to qualify for a
voluntary annexation to the City of Fort Collins.
3. On April 18, 2000, the City Council will consider a resolution determining that the
proposed annexation process for this property by the established date, time, and
place when a public hearing will be held regarding the readings of the Ordinances

PROJECT DESCRIPTION: Annexation and zoning of approximately 2.00 acres of
privately owned property located south of East Harmony Road and east of Cambridge
Avenue. The property is located within the Harmony Corridor Planning area. The
recommended zoning is Harmony Corridor District (HC).
RECOMMENDATION: Staff recommends approval of the annexation and recommends
that the property be placed in the Harmony Corridor District (HC).
EXECUTIVE SUMMARY: This is an annexation and zoning of approximately 2.00 acres,
located south of East Harmony Road and east of Cambridge Avenue. The property is
undeveloped and is in the FA-1 Farming District in Larimer County. The recommended
zoning is the Harmony Corridor District (HC). This is a 100% voluntary annexation.
COMMENTS:
1. Background:
The Kendall -Harmony Annexation #8-00 is approximately 2.00 acres in size, located south
of East Harmony Road and east of Cambridge Avenue. The property is located within the
Fort Collins Urban Growth Area (UGA). According to policies and agreements between
the City of Fort Collins and Larimer County, contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex
property within the UGA when the property is eligible for annexation according to Colorado
Revised Statutes (CRS). This property is eligible for annexation according to CRS,
requiring 1/6 contiguity to the existing city limits. The Kendall -Harmony Annexation and
Zoning complies with this standard since the property has 881.18 feet of its total boundary
of approximately 1,181.18 feet contiguous to the existing City limits. This meets the
minimum 196.86 feet required to achieve 1/6 contiguity. This contiguity occurs through a
common boundary with the Harmony Farm Annexation (July 1994) to the west; and, the
