Article 3 - General Development Standards: The application complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. A. The plat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. B. The plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way for public streets, drainage easements and utility easements as needed to serve the area being platted. This application provides 141 feet of right-of- way for Timberline Road. 4. Findings of Fact/Conclusion: A. The Timberline Road Right -of -Way Plat contains a permitted use (a public street) in the POL — Public Open Lands Zoning District. B. The Timberline Road Right -of -Way Plat meets the procedural requirements located in Article 2 — Administration. C. The Timberline Road Right -of -Way Plat meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. RECOMMENDATION: Staff recommends approval of the Timberline Road Right -of -Way Plat, File #6- 00. Background: The zoning and land uses that surround the this portion of Timberline Road are: N: POL, C, & C(County); Existing Kingfisher Point Natural Area, the Poudre River, Existing businesses between Mulberry Street and the Poudre River, existing businesses along Mulberry Street; S: POL & E; Kingfisher Point Natural Area, Existing commercial uses in the vicinity of Prospect Road and Timberline Road; W: POL & I; Kingfisher Point Natural Area, Hoffman Mill Road, active railroad tracks, existing industrial uses along Academy Court and Riverside Avenue; E: POL & E; Kingfisher Natural Area, Poudre River, Poudre River Trail, Prospect Ponds, vacant employment land, ponds. This property was annexed into the City as part of three separate annexations. Most of the southern portion of the plat was part of the Mobile Premix Prospect Road Annexation of March 1983. The portion just south and just west of the Poudre River crossing was part of the Suitts Second Annexation of February 1977. The portion north and east of the Poudre River crossing was part of the Riverbend Annexation of July 1980. At the time Timberline Road was built in 1998, this portion that goes through Kingfisher Point Natural Area was not dedicated. This application is to plat and thereby dedicate this undedicated portion of Timberline Road. 2. Article 2 - Administration: The application complies with the applicable requirements of the Luc, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review ITEM NO. College Ave. Fort Collins, CO 80524 PROJECT DESCRIPTION: This is a request to plat a portion of Timberline Road that is currently not dedicated as street right-of-way located within the Kingfisher Point Natural Area north of Prospect Road and South of Mulberry Street. This portion of Timberline Road is currently improved to 4 lane arterial standards. The site is in the POL — Public Open Lands zoning district. RECOMMENDATION: Approval EXECUTIVE SUMMARY: This request complies with the applicable requirements of the Land Use Code L( UC), specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Division 2.4 - Project Development Plan located in Article 2 - Administration; and Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards.
