Finch on February 9, 2000, and explained to them that the application needs to include a request to amend the Structure Plan with proper justification supported by principals and policies in our Comprehensive Plan. d. The rezone request must be consistent with the Structure'Plan in order to be approved. e. It seems fairly unlikely to staff that you will. .find principals or policies in our Comprehensive Plan to justify amending the Structure Plan in this location to Medium -Density Mixed Use Residential, but you need to attempt to make that justification to have any chance at all of amending the Structure Plan. City Attorney: a. Section 2.9.1 of the Fort Collins Land use code specifies that amendments to the Zoning Map may be proposed by the City Council, the Planning and Zoning Board, the Planning Director, or the owners of the property to be rezoned. b. The petitioner is identified as Mark Faulkner, but the owners are Wilber & Barbara Aanes, and Edward J Jaerger. You must either resubmit a rezoning petition designating the property owners as the petitioners (with their signatures), or you must obtain a power of attorney from the property owners to act on their behalf for the purpose of the rezone. 2. Advance Planning: a. The rezone request is not consistent with the structure plan (which is a component of the city's Comprehensive Plan). 3. Current Planning: a. This item will be going to the Planning and Zoning Board Hearing on March 16, 2000, first reading at City Council on April 4, 2000, and second reading at City Council on April 18, 2000. b. The application cannot have a staff recommendation of approval because the proposal is not consistent with the city's Structure Plan. The Structure Plan. designates this site as Low -Density Mixed Use Residential, but would need to be designated as Medium -Density Mixed Use Residential on the Structure Plan to warrant rezoning to MMN. 281 North College Avenue • PO.
