The developer and/or his subcontractors or employees may enter College Park -Rams Pointe for the purpose of matching the proposed grade of the currently undeveloped property to that of College Park -Rams Pointe. We understand that this will entail building up the grade on the southeast comer of Rams Pointe to the new level of the currently undeveloped property and will require that current landscaping at Rams Pointe be disturbed and/or removed. The owner's of College Park -Rams Pointe also understand that heavy machinery may be required to enter Rams Point for the purposes of grading. The developer will be required to provide the Property Manager, Polly Cisneros, with at least seven (7) days notice of intent to enter Rams Pointe. The developer shall provide all safety devices -barricades, netting, lighting, etc. to minimize access to the work area. The developer will be required to provide all labor for the installation and removal of these devices as well as labor that may be required to direct traffic or otherwise ensure the safety of the resident's at Rams Pointe. The developer will be required to replace all sod in the area to be regarded as well as replace any trees that are to be removed for these purposes. In addition, the developer will be responsible to repair any damages to the parking lot, curbs, sprinkler system, vehicles, or any other part of Rams Pointe's property or the property of it's residents that is damaged as a result of this work. The developer will be required to provide the Owner's Representatives of Rams Pointe with a certificate of insurance, naming Rams Pointe as additional insured. The developer agrees to carry liability insurance in an amount of no less than $1,000,000. This agreement to enter the property shall terminate upon completion of the newly developed property.
