a concrete sidewalk on the south side of Prospect Avenue, unless it would be built to standards in the ultimate
location for a constrained arterial. Transportation Services stance is that the proposed development needs to
satisfy the standards as outlined in the Land Use Code and LCUASS for pedestrian LOS within a school
walking area. As previously mentioned the sidewalk would satisfy that pedestrian LOS. However, due to
existing constraints along Prospect a modified 7-foot attached concrete sidewalk would be acceptable. Within
the Development Agreement the City's Pedestrian Access Program will agree to work with the developer to
secure the necessary access easements along Prospect. A detailed cost estimate and design for the sidewalk
construction needs to be provided by the developer to the City for review by Transportation Services. For this
improvement it will be the financial responsibility of the developer to construct the sidewalk, secure the
necessary access easements from nearby property owners and any court costs that may arise from securing the
easements.
Item #3 Is the additional sidewalk width the City is requiring along the eastern side of Roberstson
Street within the proposed development reimbursable through the street oversizing program?
Response The required 6-foot sidewalk width along the eastern side of Robertson Street is not subject
to a reimbursement through the street oversizing program. Please refer to section 16.2.1 (A) of the LCUASS,
which states "the local entity engineer may require additional width for activity areas and routes leading to
these areas. The final sidewalk width shall be determined through additional study of higher pedestrian traffic
areas.

In order for the proposed Pinnacle Townhomes PDP to receive a recommendation for approval adequate
pedestrian level of service (LOS) within a school walking area must be achieved. Two options previously
mentioned to the developer were a pedestrian signal at Robertson or a sidewalk along the south side of
Prospect Street. At the request of the developer the Transportation Service Department discussed further the
development's lack of pedestrian LOS. The following three items proposed by the developer from our
December 17, 2001 meeting were considered, which are immediately followed by Transportation Service's
response.
Item #1 Does the City's pedestrian LOS regulations allow for leniency for an infill development
along a constrained arterial, and which is located near a City trail?
Response The City does accept a trail connection in lieu of a street sidewalk system, if the pedestrian
LOS can be satisfied. The Larimer County Urban Area Street Standards (LCUASS) states, "off — road multi-
use paths may also be considered if practical to provide more direct pedestrian routes." As measured by the
LOS criteria the Spring Creek Trail route as described in the Transportation Impact Study (TIS) is
approximately two times the distance from the entry of the proposed development to the southwest corner of
Lesher Junior High School. Thus the Spring Creek Trail can not be considered a multi -use path that satisfies
the pedestrian LOS for this development. Furthermore, please refer to the LCUASS section 16.2.1 (M),
which states as follows; "The local entity engineer may require off -site sidewalk extensions to provide
pedestrian connectivity to destinations within a'/a mile of the project as identified in the TIS. Additional
offsite sidewalk construction extending greater than '/a mile from the project may also be required in some
circumstances such as when the project is within a school walking area boundary."
Item #2 Can the proposed development make a proportional contribution to the street over sizing
program to construct a concrete sidewalk along the southern side of Prospect Avenue from the western edge
of the proposed development to the pedestrian signal at Stover and Prospect?
