A: Yes, wetland areas have been delineated & endangered species
surveyed.
Q: Are studies in the public record?
A: Yes, the studies are available in the Current Planning Department.
Concern: Noise impacts — concerned that there might be high occupancy per
unit and college students
Q: Does the city regulate how many attached units are in the neighborhood?
A: No.
Q: Can the developer change the plan part way through construction?
A: No, not unless there is an amendment to the plan. This would require
notice to all property owners within 500 feet and a formal review.
Q: Will this set a precedent for development on adjacent properties?
A: It will be developed at the maximum density permitted within the LMN
zoning district. Whether the adjacent properties are developed at a similar
density will be an option for those property owners.
Q: Can the City/developer develop a plan covering a larger area?
A: To the extent possible, the City has required an east -west public street on
the property that could be extended to the east and west onto adjacent
properties. The developers of the subject property do not have ownership
to the adjacent properties although they unsuccessfully tried to acquire the
property to the west.
Q: How many units are condos?
A: 16 (of 54).
Q: What is a townhouse?
A: The units are attached and land underneath the house is part of the
ownership; the units typically have multi -story living space.
Q: What is a condominium?
A: Ownership does not extend to the land, just air space.
Q: Can the project be done without condos?
A: No, the project would not be economically feasible.
Q: Livestock issues — how will horses be impacted?
A: This should not be an issue.

Q: What is the building setback off E. Prospect St.?
A: 30' from the property line and 70' from the curb.
Q: Can this project be kept from being a rental?
A: No.
Q: Will it be a rental restriction in CC&R's
A: No.
Q: Will there be a HOA?
A: Yes.
Q: Is there a management company for the HOA?
A: Yes.
Q: Will sidewalks be installed? Can the City extend/expand the sidewalk
system east and west? Could the developer build these?
A: An 8'-wide sidewalk will be constructed along the north property line
Q: Storm drainage flows to the east; will water be able to continue flow? Will
other properties be impacted?
A: Storm water flows need to meet historic flow rates.
Q: Given the density, can sewer be handled?
A: Yes, there is excess capacity in the sanitary sewer system.
Q: Where is the water main? How big? How will water pressure be
impacted?
A: The water main is located in E. Prospect and is of adequate size.
Q: How are fields irrigated?
A: Not sure. Irrigation rights are not provided on this property.
Q: Have you looked at other areas that are less congested for this type of
development?
A: No.
Q: How did the city arrive at this density?
A: The 5-8 dwelling units per acre density range in the LMN zoning district
was determined as part of City Plan and was implemented through the
Land Use Code.
Q: Are there restrictions for car ownership within the development?
A: No.

Q: What is the acreage?
A: 6.95 acres minus street rights -of -way.
Q: How much fill will need to be added to bring units out of the floodplain?
A: 2 units will be impacted — they will need to be a minimum of 18" above the
high water mark and will not have basements.
Q: Were the stormwater calculations done since the new floodplain
regulations came into effect?
A: A preliminary study had been completed based on the new standards; an
additional hydraulic study is needed.
Q: Do units have basements?
A: Yes, except for two units (see reference above)
Q: What are the unit prices?
A: Townhouses = $140-150K / unit
SF = $180K / 2 bedroom 2.5 bath
8 plexes = $120-130K / unit 2 bedroom 2 bath, 1000 sq. ft.
Q: Will there be access to the Spring Creek path during construction?
A: Not during street construction, otherwise it will remain open
Q: Who owns the property?
A: Barker Construction & other partners.
Q: Which are the most affordable units?
A: The condominiums.
Comment: Concern was expressed about construction debris on adjacent
properties
Q: Is there a plan for a traffic light?
A: No, a traffic light is not warranted.
Comment: This section of Prospect St. is very congested — traffic backs up to
this site from the Lemay intersection.
Q: Is the landscape plan accurate?
A: Yes, it meets City requirements. .
