A draft development agreement is being provided for your review with this letter. It should be
noted that this agreement is still being reviewed by the City Attorneys office and that some
changes may need to be made. Please review this document and provide me with any
comments you may have. In order to finalize this document I will need the to have your contact
information to fill in the blanks on page 14 of the document and I will need to receive a cost
estimate for the Street Oversizing portion of this project. This is just an estimate of what the
costs will be for the oversized portion of the Elizabeth Street work (.5 feet of sidewalk and the
oversized portion of the pavement section). The actual amount of reimbursement will be based
on the actual construction costs. The estimate is just used to help with our budgeting of funds.
In order to facilitate the ditch work the DCP will be issued with the condition that no other work
on the site can occur until the easement is granted and the full utility plans are approved.
In order to review the DCP application and verify the inspection fee amount and the warranty
bond amount a set of current plans are needed for this review. Please provide a complete set
of utility plans.
In summary the following items are needed from you and/or need to be completed in order for
you to start work on the box culvert:
1. A complete blueline set of utility plans needs to be provided.
2. A revised and corrected plat needs to be provided.
3. .Off -site easement (from Sienna) needs to be provided.
4. Filing fees for the easement need to be provided. This amount will be determined once the
easement is received.
5. The Pleasant Valley and Lake Canal Company has signed the plans before they are
submitted to us for signature.
6. A final development agreement signed by you.
7. A cost estimate for the amount of street oversizing reimbursement due is received.
8. The applicable sheets of the utility plan mylars are signed with indication that approval is
only for the culvert and ditch work and mylar copies and 6 sets of signed and stamped
blueline prints are provided.
9. Erosion control deposit made with Stormwater.
10. The inspection fees paid.
11. The public infrastructure bond or letter of credit received in acceptable format.
12. DCP permit signed by the applicant and the City.
The following would need to occur before any other construction on the site can occur:
1. The easement on the parks property is granted by City Council.
2. The full utility plan mylars are signed and mylar copies and 6 sets of signed and stamped
blueline prints are provided.

Dear Vicki:
I received the application for the Development Construction Permit (DCP) and can schedule the
DCP meeting for March 6 from 2:30-3:30. As indicated in the pamphlet DCP meetings are only
scheduled on Wednesdays. The meeting will be in Conference Rooms C and D here at 281 N.
College. You are responsible for notifying your Contractors and Engineers and having them
attend the meeting.
It should be noted that the meeting can be held on this date, but it does not necessarily mean
that the permit to start work can be issued on that day. A DCP cannot be issued until the Utility
Plans and the Development Agreement are signed, the Plat is accepted for filing, the inspection
fees are paid, the erosion control deposit is made (with Stormwater) and the public
infrastructure bond in acceptable format are provided and accepted.
The plat as submitted yesterday cannot be accepted. The plat has included a portion of land
that was already platted and is believed to be owned by the City. This needs to be resolved
before the plat can be accepted and the DCP issued.
The utility plans cannot be fully signed until the easement is obtained and granted by City
Council. This is because until this easement is obtained the project does not have an outfall as
designed. In order to facilitate the construction of the box culvert and the ditch work before the
ditch starts running this specific portion of the work can be approved. This would be
accomplished by bubbling this area of the.plans and indicating that only that area is approved.
We would then fully approve and sign a second set of mylars once City Council has granted the
easement.
Prior to signing the mylars whether for the interim work or for full approval of the set, the
Pleasant Valley and Lake Canal Company will need to have signed the mylars, and the off -site
easement to the East being obtained from Sienna will need to be provided to the City in
acceptable format along with the filing fees for this document.
